I signed a contract for HGV owner club 10 hours ago and now regret it. What should i do?

I signed a contract for $15,000 with an annual maintenance fee of $899. My payment is $251/month. I live in Texas. Is there a way that I can cancel the contract
 
Get out your purchase Docs and find the instructions for rescission - then follow the instructions exactly. Don't be tempted to hand deliver it to the sales office - they have no motivation to help you. Mail it using the exact mailing instructions and be sure you get a delivery receipt.
 
It doesn't really matter where you live. Where did you sign? And where is the timeshare located? Different states have different timeframes for rescission/cancellation. Good thing is that you are still within all those timeframes, but Nevada runs out in only five days.

Really more important is to ensure you retain proof of mailing. It may not get delivered, but having proof of mailing ensures it was sent and you can prove it. USPS Certified Mail and USPS First Class Mail with Certificate of Mailing provide this.

Just to clarify - proof of delivery will automatically include proof of mailing. Yim8896 - you just signed 10 hours ago, so you are going to be fine, just find the instructions and follow them.

Thank you! I found the document and one of the instructions is to hand it personally to them. I don’t want to see them again. I know they will try to convince me again. I’ll send a cancellation request by certified mail. Now, what if they say they never received my mail?
 
You have the right to legally rescind if you do so within a few days.

Check the paperwork you signed and there should be an exact address as to where you can send your rescission paperwork. Any buyer who signed the paperwork needs to sign the rescission papers (i.e. if you and a spouse signed).

The rescission paper should be sent to the address they provided in your documentation. Send it to them via the US Postal Service trackable CERTIFIED MAIL and get it postmarked on Monday, April 7th. Also send another copy using a CERTIFICATE OF MAILING. Retain a copy of the rescission paperwork for your own records as well as any USPS Postmark Receipts.

Beside the US Mail, you should also be able to send an email to rescind. I suggest you do every single option in case there are any "lost in the mail" or "electronic" problems and these things will never become an issue (you've covered all the bases).

Are you overdoing it? Heck yes, but when thousands of dollars are on the table then why not?


Exact wording? All you need to say: "After careful consideration I have decided that buying this is not in my best interest and I am exercising my legal right to rescind my timeshare purchase that I made on Sunday, April 6th, 2025". Sign it and date it.

Thank you! I really felt the pressure, and they were trying to connect with me on a personal level. I felt so bad saying no. I went back to the hotel and regretted my decision. I’ll send out a letter tomorrow by certified mail. By any chance, do you know if they will cancel my contract right away after receiving my letter, or are they going to give me a hard time about it
 
All of the above plus if more than one person signed the original contract, then everyone who signed it must sign the cancellation. Put a date, contract number and anything else that is stipulated in the cancellation section of your contract.

They may try to get you to stay, offer you a bone or something. Just ignore them. You will get a refund back on the original form of payment within 30 days. If it gets close to 60 days and no refund, reach out to your card issuer to challenge the charge. That is where the copy of your contract, cancellation letter, and proof of mailing will really come in handy.

So do i just mail them a one single paper that my spouse and I signed where it says “the purchaser of timeshare may cancel, by written notice, the contract of sale until midnight of the fifth calendar day following the date of the execution of the contract” and my own written cancellation letter, just 2 letters, right?

Are you all set on what you need to do or already sent in your contract cancellation letter? No worries because HGV will honor this letter.

The right to rescind (cancel) the contract is provided by applicable state law; you are not making a “request” that they have any option to decline.
You are informing them that you are now exercising that legal right. Do it correctly, promptly, in writing, under signature, sent by USPS certified mail, and all will be fine.

Certificate of Mailing is by far the most underrated method to send any documents where you need confirmation of mailing. It doesn't get mentioned enough here. USPS Certified Mail is slow. It is cheap. It only cost me $2.20 in addition to the First Class Stamp the last time I used it.

We've seen several recent reports here where buyers were stressing over their USPS Certified Mail not showing as delivered. Now, that doesn't mean it won't be delivered and the developer still has to abide by the law which is based on post mark date. But it can still be stressful because if it isn't delivered it may mean a few more hoops to jump through to ensure the rescission is taken care of. We're usually also talking about tens of thousands of dollars.

I always try to suggest two methods of delivery.
  • Email or Fax (if available) then USPS First Class (stamp) with Certificate of Mailing or
  • USPS Certified Mail then USPS First Class (stamp) with Certificate of Mailing
With Certificate of Mailing, it is important to use a First Class stamp and not let the post office just print out an electronic stamp to stick on. When they do that, you won't be able to use and retain form 3817 which contains a physical post mark as proof of mailing. If they use the electronically printed stamp with the (QR?) code on it, the paid receipt is really all the proof they give you. I learned this when mailing an extension to file tax returns.

Great job @Yim8896. Definitely focus on getting this rescission done first. Then hang around and learn more about the HGVC system. It really can be very good if one can make it work. And, of course, buy resale.

Use a UPS Mailer with signature confirmation, make paper and digital copies.

These snakes at the Elara almost got me, I stood on property and was able to go to the 59th floor and hand it to one of them, then they said, oh he is on vacation for a week. I didn't leave until I had written proof via paper and email.
 
I resended a contract - just do exactly what the information on the paperwork. I did it, they contacted me about wanting to back out and I told them that I believed that I was overextended after taking time to sit down and really thing about it. I would not give any details nor have any conversation about how to stay in. If you have doubts later you can always rebuy - but get out now with any doubts!!!!!
