I need to rescind but I don't even have the contract!

So we're at Wyndham in TN currently and got talked into purchasing 126,000 after the sales rep basically promised us that would buy us trading through RCI into DVC for a fraction of the cost (we've debated DVC for years but truthfully cant afford it). This was more affordable but now looking online, I am reading we were lied to that DVC is very hard to trade in RCI plus our points is barely going to get us any vacation time. So we are resciding. Problem is, they said they went paperless and I docusigned but the contract hasn't come to my email yet so I don't even have a copy yet. We are still here at the resort (were stayed at a wyndham resort at a friend's timeshare) so I can go by tomorrow and ask for a copy by I definitely don't want them thinking I'm up to something and pushing me into anything else. My sales rep was actually nice but this other guy he brought over (he was new and didnt know about Disney) was awful. I'm just looking for any input I guess.

I see you’re a guest here. First I will say, pay for membership. You’ll get access to the “sightings” forum. In there you’ll see when people see DVC. You can get DVC, but you will most likely be getting a one bedroom only and mostly at Saratoga springs resort 90% of the time. Next you want to buy resale. I just went into contract with a resale RCI with 178K points for the purpose of trading into DVC. With that being said, there are plenty of other RCI resorts to use as well. For the amount of points you purchased 126K you would be able to get into DVC sometimes twice or even 3 times when they offer rooms for 41K. Again, I’m learning all of this through the sightings forum here. So upgrade from guest to member for the 15 bucks.

second, make sure whoever signed the contract and who ever is named on the contract signs the rescission letter. Also, youwant to send it certified United States postal service with return receipt requested or delivery confirmation. The letter will be simple. List the contract number and that you intend to rescind the contract and cancel within your right to due so. You then must mail it to address listed on the contract.

How much were they charging you for the 126K points?

Rescind!!! 126K will NOT get you into Disney. Not gonna happen. Stay away from the sales room! At most, go to member services and say that you'd like a copy of what you signed (Your dad, mom or lawyer want to review it!) then put the number on your rescission letter and get it in the mail Monday- Certified w/return receipt. You can't mail it before Monday anyway.

Just, for cryin' out loud don't let 'em talk you out of it.

Check my post above and see if that’s the correct address. Also, 126K RCI points can get you into DVC. I won’t go into what’s Been sighted but the highest I’ve seen reported was 85K with most around. 51K-68K for one bedrooms for a week.

however with Wyndham points, 126K correct not really enough.

Yes, good move to rescind. You can buy the same on the resale market for a fraction of what your developer purchase price was!

Thank you everyone I emailed the financial gentleman and told him the DocuSign contract never came through. If it's not in my inbox by the time we check out at 10, I'll go to the sales office and ask for a copy.


I lectured my husband an hour before this breakfast that we were not going to be talked into anything. He got me though because DVC is my dream. Not because I think financially it makes the most sense but because we are that Disney obsessed family but can't really afford deluxe accommodations on our yearly trips. When I told him that, he used it against me telling me Wyndham owners could easily book DVC properties for just 77,000 points plus $229 anytime! And I thought what a great deal! We can do that every year and still get a couple weekends away!

If DVC is your dream and you were gonna drop 19,500 I can give you the number to a sales rep in DVC if you want. He will go over options. That’s your best bet.

Right now I need to get past this! Due to school schedules as usually travel to Disney in peak times and I think I saw we would need like 30K to get into DVC for a week? Could be wrong. I do like that everyone we talk to at Disney isn't sleezy and salesy.

Almost every DVC exchange is available for 105,000 Wyndham points. A handful are 126,000.

However, the main point that we all agree on here is it’s definitely not a good reason to buy points directly from Wyndham and rescission is essential.

You have 10 days to send the rescission letter after signing the contract. The day after you sign is day 1. Don't press it, mail the rescission letter tomorrow to the address in post #3. It doesn't matter when they get the letter. the postmark date is the official date of the rescission. Email, telephone calls, texts, etc. don't count and have zero legal standing.

If you are convinced that Wyndham ownership is your best route to Disney access, they are available for mere pennies on the resale market and are just as valid as those bought from Wyndham.

Thank you everyone! I went to sales office this morning acted like everything was great and got my contract. We're headed home and typing the letter this evening. I will take to post office as soon as they open tomorrow morning. I am SO grateful I researched more and found this group in time. What was I thinking???

I don't think it is at all. He totally lied to me telling me that. Maybe a resell is a route we will go or maybe we'll go DVC ( I do have a bit more faith in Disney company ethics and plus I believe DVC isn't for life but deeds out after 50 or so years) but right now I just feel lucky we are hopefully getting out of this.

I get it. And I also get this is there job. I take responsibility here too. This isn't like my husband and I at all to make decisions like this! We bought a car 2 years ago (out of necessity after a deer running out in front of us totaled ours) and it took me 3 weeks to decide (I think my insurance was annoyed paying for a rental). We have toured DVC and spoken with them (I have never once felt pressured there) but it just wasnt in the budget. We honestly went to this breakfast to get the free gifts. I told my husband there was NO WAY we would buy anything. My parents used to do these tours all the time growing up and never once got suckered into anything. I told him our goal and he used it to make us think we could achieve it easier through Wyndham. And of course, they don't give you time to really discuss it, research it, they are ready for you to sign and next thing I knew we had done it. THEN I researched. And texted my older and wiser mother who said I hope you know what you got yourself into.

I'm just really grateful I found all this the next day because if it sounds too good to be true then it probably is and we might (praying) be the lucky ones who can get out of this contract becuase we realized what idiots we were in time. Not that timeshares can't work great but I had no idea you could own for a fraction of the cost. And for what we want we would need way more points or we just need to do DVC direct when our budget allows.

I purchased RCI points to get into DVC when i can. But there are plenty of other RCI resorts to book into as well. If you just want DVC and are ok with spending that money, buy DVC or at least buy resale DVC (but know and be ok with resale restrictions on resale DVC contracts). If you’re not going to go to DVC every year, then a smaller 100 point contract may be all you need and you can bank and borrow for larger rooms or longer stays.

Letter is written exactly as suggested above! I included everything they could possibly need. I am also including the first page of the contract and the page with Tennessee law stating I have 10 days and what I needed to do.

Made additional copies for my records of everything just in case. I plan to go to post office when they open in morning. I know I need to send it certified. I've never mailed certified. What exactly does this mean? Should I overnight it in case I did something correctly I will still have time to fix it? Should I fax it and email it to and tell them a certified letter is following? Just want to ensure this all goes smoothly.

Also will I need to mail back the box they gave me with a tote bag, pins, booklets, plus the gift cards for the tour?

I have traded into DVC 4 times to stay in a 1BR at Saratoga Springs. I did this with resale 98K RCI points Grandview Las Vegas contract I bought for $200 on ebay.

There are also lots of other great RCI timeshares in Orlando if you visit there often.

But before you buy anything, study up. Timesharing is complex and you don't want to make an expensive mistake.

Yes after I get myself out of this issue (which I see I'm a lucky one who caught my mistake in time many aren't as lucky) I am going to learn, learn, learn. I don't even know what half of you are talking about we've never timeshared once. I mean we've stayed at people's before .. they book theirs for us and we show up and usually just PayPal them money for allowing us to use them. Otherwise we have always vacationed directly from a hotel, Disney or renting a beach house (VRBO).

Bring the envelope to the counter and tell the agent you need it sent certified mail, with delivery confirmation. They will handle it for you. If you’re unsure ask. Don’t do it yourself, have an agent handle it all for you at the post office.

You are indeed among the fortunate people who have found TUG in time to rescind. The timeshare company is required by law to rescind your contract when you comply with the rescission instructions given in your contract. You are within the specified time frame and you can rest assured that all will be done legally once you mail that letter and have the receipt from the post office showing when it was mailed.

@collinsbrooke89 Congrats on rescinding in time. Make sure to keep a copy of the certified mail receipt in your files because the date on that is proof you rescinded within the rescission period. It is not when they receive it.
