I NEED HELP WITH CANCELLING

Hi everyone, new here and new with timeshares.

Been reading up a lot and have decided to cancel/rescind.

I’m within the 7 day period. I was wondering if a letter is needed as well or if a “notice of mutual right of cancellation of timeshare purchase” is enough?

It’s stating that I can fax this form, but should I send via mail as well?

As far as the “gifts” after purchase and other documents, what else should I send back?

In the contract, do they provide a cancellation page to just sign and return? If so, then sign it and send certified USPS but you can also fax, if that is shown as an option. I would do both or certified USPS at a minimum.

If there isn't a cancellation page, some contracts have one and some don't, then write a letter saying that you want to rescind and include the contract number, names, date signed, property, and all owners need to sign it and send certified USPS.

If you bought in Nevada or Nevada, I understand they have a form that is part of the contract. Using that should be enough. Your intent to cancel should be clear with whatever you send to the timeshare company.

My suggestion on method of delivery. Use one that is trackable. USPS Certified Mail is good but it is slow and some people get stressed out when their letter isn't delivered timely. I also suggest to send a second letter via USPS First Class Mail (use a stamp) and add Certificate of Mailing. Certificate of Mailing gives you proof of mailing by providing you with a postmark stamped form from the USPS. It is cheap too. Less than $3 with the stamp and Certificate of Mailing form 3817.
 
Thanks for the replies everyone! This is from Hawaii and it came with a notice of mutual right of cancellation of time share purchase. It says “TO CANCEL THIS TRANSACTION, MAIL OR DELIVER A SIGNED AND DATED COPY OF THIS CANCELLATION NOTICE OR ANY OTHER WRITTEN NOTICE, OR SEND A TELEGRAM TO:”

Also with “Fax this signed cancellation to _______”
 
@jjillin77, once you cancel expect a phone call from your salesperson. There will be no need to answer or talk with them because they have NOTHING to do with handling canceling this TS. They will only try to convince you to change your mind in order to save their commission.

Just send that. Hawaii sometimes provides an email address to rescind also. If that is provided, use it also.

Then use the fax option if you have access to a fax machine or other method to send a fax. Then also follow it up with at least USPS First Class Mail with Certificate of Mailing. Keep the small postmarked slip the Post Office gives you from the Certificate of Mailing. This is your proof of mailing.
