How to get out of new HVC

We purchased with HGVC about 6 months ago. We had no intention of purchasing but they told us a few things to convince us. It turns out those were lies. We tried texting, emailing and calling daily for months to get more information on what we were promised and then we found out we were lied to so to late for the recision period. Submitted a complaint to corporate and got nowhere so I filed with the BBB. That finally got their attention but basically told me it was our word against their sales agent and the sales agent claims he never said it . They have offered us $2000 in maintenance fees credit but I want to be completely refunded because with out those things that were promised this time share is useless to us as it doesn’t fit the way we “travel”. Any recourse? I thought about hiring an attorney but hard to know who is a scam and who isn’t and I think it will again come down to their word against mine. Do I just take the $2000 and cut my losses or is there anything else I can do?

You are in a tough spot. Do you have a loan? If so, it is even harder to get out. If you paid for it, then you can sell it but at about 10% of what you paid. HGV is not good about taking deeds back. You may be better off taking the $2k credit and using it. You could default but it hit your credit.

The other route is like the one below.

Here is the original TUG thread about it when the owner wanted out and also said that the sale's person lied to them. The reality is that most sale's folks like...and there is not much that you can do...if it isn't in the contract, then it probably isn't true.

We usually strongly recommend against using an attorney. What's an attorney going to do for you but suck your wallet dry? As you said, it's "their word against [yours]." What counts is what is written in the contract.

Besides not hiring an attorney, we also strongly recommend against using any other "exit" company that claims it can get you out of your contract painlessly with minimal financial problems. Those are scam companies.

Read your entire Contract closely. It is likely that you are required to submit any disputes to Binding Arbitration.

That means you acknowledge and agree the only representations you are relying upon in signing the agreement are those that are actually written into the agreement. Thus, even if you were to ever get to litigation (which most likely would be an arbitration since most of the timeshare contracts contain an agreement to arbitrate disputes) over the contract, there is no "he said, we said" discussion. It is the written agreement, not any verbal assurances or verbal promises made to you prior to you signing the contract, that control.

Unfortunately, now that you are past the recission period, you don't have a lot to use to exit the contract, unless you have the things you feel are lies in writing or recorded. There are others who have come to TUG too late to act under the recission rules. So now, it might be best to take the MF credit and learn how to use the system so that it works for your particular style.

The HGVC system is actually quite good, once you learn how to use it. There are lots of us on here, ready and willing to help with that and to answer your questions. We all travel differently, so there is likely more than one member who may have a travel style similar to yours.

Maybe start by explaining what you thought you were getting, versus what you now understand you have. It may not be as bad as you fear. Plus, if you tell us a bit about your travel style, hopefully we can make some suggestions on how to make the most of what you have.

all well put above...sorry you didnt find us sooner...but your options are straightforward.

continue to be a squeaky wheel, and up the squeakyness in the hopes that you will eventually become more trouble than you are worth and hgvc will try to negotiate some sort of settlement with you (low chance of success, just not zero!)

stop paying and roll the dice on the consequences. can probably guarantee a credit ding defaulting on the loan along with a ton of efforts/threats to collect....you just have to decide what all that is worth compared to paying off the loan while also paying annual dues.

That’s for state legislators to change the law on disclosures relating to this type of high pressure sale. But keep in mind, each state has consumer protection laws in place providing for rescission rights. If a state legislature wants to make the consumer’s rescission rights more visible to the consumer, then they must pass a law saying that. There’s only so much the law can provide. It’s still up to the consumers entering into these contracts to read them.

I am going to edit this to say that it is “paid off” in Hiltons eyes. They had both my fiancé and I take out the Hilton credit card and split it half on the credit card so we are still paying that off. We have 0% interest until next July so we’re just slowly chipping away at it now. I’m just worried because we really really need that money for our trip to Greece next year that they promised us we could use this for and now we can’t so now I need to come up with more money for lodging. They told us our points would pay for all lodging, and we could even use some of the bonus points. They gave us to pay for some of the airfare. And I didn’t realize how useless the Hilton credit card points are for travel as opposed to my other credit cards.

It’s on our Hilton credit cards and we can’t ruin our credit right now because we’re in the process of building a house so we may need to take out short term loans.

I think that this will be your best option. Hopefully, you bought on the HGVC side (deeded property).

Good question. I have no idea! 😬. How do I find that out? I feel so stupid because I’ve swindled into timeshares before and I said I will never be swindled into them again, but I guess I was wrong. My fiancé and I are starting our life together and our kids are all about to be 18 and we just felt like this was a perfect time to travel together and this would really help us but not if we can’t use it. 😔

It is a good system. We have owned for over 20 years and use the properties all the time. Our kids have grown up in HGVC properties but the sales folks are terrible.

If you want to stay in the properties, then I think you will like it but it comes with this cost when you buy retail.

HGVC is a deeded property. So if you own on the HGVC side, you will own at particular resort in a particular room side and usually a specific season {for example, Valdoro Mtn Lodge, 3BR platinum winter ski season} (your MFs are also based on the property that you own). This forum is for HGVC and HC (Hilton Club). If you own trust points in a specific collection (such as HI or US collection), then you bought into HVC (Hilton Vacation Club), formerly DRI. There is a different forum for HVC. I suspect that you were sold trust points in HVC.

Yes, there is a link in the HGVC portal to the HGV version of RCI. Basically they have removed lower tier properties and you have 3 years worth of HGVC points to use there.

In HGVC, you will have a specific property since they are all deeded. You will then have either a floating week in a season or a fixed week. If you don't have this, then you may be DRI. Their Trust points tend to be in a collection of properties.

It’s on our Hilton credit cards and we can’t ruin our credit right now because we’re in the process of building a house so we may need to take out short term loans.

You may need to do some soul searching and consider delaying the Greece trip, I'm sorry the sales person lies got you in this mess. We see this story repeated here on TUG all the time, the sales person befriends you to learn what your plans are then crafts verbal promises that are non binding to get you to buy. You really need to look in your account to find out what you own and how to best use it, or take the hard hit and dispose of it.

My wife and I had a dream Alaska trip planned earlier this year but health concerns made us cancel and pivot, it's life, don't create a financial hardship by not being flexible.

To the OP,
We also own ours after a sales presentation and have learned to make it work. As you bought retail, you do have Max exchange to access to the HVC (former diamond) resorts and there is one in Greece, but I know nothing about it or its availability, though I assume that it is probably a bit challenging to book at only 6 months out. That said, travel without school schedule restrictions will make availability better if you visit places in the shoulder season. For example, I did go to Greece many years ago in October and it was fantastic and we still had warm ocean water to swim in. With the credit card, you may have enough points to book Hilton hotels in Greece with the honors points where you stay 4 nights and get the 5th free. This might adjust your travels some, but it could be a way to make it work. I'm sorry for your frustration, and I do hope it works out for you to get released from your contract, but otherwise, learning how to use it is not a bad way to go for a while. Maybe it'll be better than your previous experience. Good luck!

Unfortunately I can not. It is for my daughters high school graduation present that I have been promising her since she was 6 so I am not going back on my word. Unlike timeshares my word means something to me.
