Help with rescinding timeshare

I want to rescind my timeshare that I signed for last Wednesday at Westgate lakes in Florida. The problem is I was planning on doing it at home but the folder that has all the documents got lost somewhere between Florida and Utah. What should I do? I'm down to the wire on this. I have my Westgate account number and the stupid cheap tablet but that's all I have. I'm so stressed it's making me sick to my stomach. I called Westgate and told them I lost the documents and asked to have them emailed to me for my records. They said they'd put in the request which I'm assuming means they'll get them to me after the ten days are up. Any help is greatly appreciated.

You should be able to do it with the account #n you have. Just write a simple 'I/We wish to cancel and rescind the purchase of #account. Dated 9-XX-2023 at (place)

You don't need a reason.
Say that promotional materials will be sent back under separate cover. Then do it by cheapest means.

Send it to the Old Wintergarden Road address in Ocoee, FL. (google it) by USPS Certified Mail w/return receipt (so you'll know it was received. Put Attn Rescission on the envelope.

Then wait. Don't answer the phone from them. No good can come of that. They MUST process the rescission, but are not obligated to inform you of the progress or completion of it. It can take up to 45 days to see your refund, but will probably be much less.

agree with above, send in a letter and retain proof to show you tried to rescind.

are a number of addresses ive seen here on the forums you can send a letter too to make sure if you want to be extra careful, spending extra postage for each one is ultra cheap insurance!

The address I found was 2801 old winter garden rd ocoee fl 34761. I sent one there and also to the resort directly. However I'm concerned because I tracked it and USPS says the one to the resort was received but the other one says it was "delivered to agent for final delivery". Have you heard of that happening before?

I'm concerned where it says "delivered to agent for final delivery" instead of saying it was delivered to the recipient. I googled what it means and it says it could mean a few different things which is very worrisome to me. Have you heard of anyone else's saying it was delivered to an agent instead of recipient?

Yup. But you don't need to worry about it as it is now their problem.

As @amycurl has said, it is ONLY the Postmark date that counts. Does your postmark on the Postal Receipt show it was mailed by the legal rescission date? They may not get your letter until next week or next month. As long as you saved your Certified Receipt then you are all set.

Sit back, relax, and allow up to 45 days for your refund (usually sooner). They have no requirement to acknowledge your rescission but they DO have to act on it by law!

Yes it was sent before the ten days were up. Thank you very much for all the help!!
 
Same thing for us, flying at home Delta lost our briefcase with all the documents related with the scam and we have been requesting a copy of it but both (the sales agent and the notary) are only buying time by making excuses. When I mentioned to the notary that I wanted to make use of my right to cancel and for that I needed him to tell me the address that appeared in the contract for the sending the letter (due they won’t send the documentes within 10 days) he refused and told me that I should have thought about that before. Finally I just obtained the contract number.

I hope as we read, that we just need to send the letter with contract number to 2801 old winter garden rd ocoee fl 34761, am praying that the clause does not include any more demands that we are omitting.

If someone had a recent contract signed in Orlando and could share the clause with me, I would be infinitely grateful.
 
Hey there! Was curious I'd this was resolved. :) Hubs and I just sent our letters off to Ocoee and Gatlinburg(where we bought ours) a few days ago. Letters sent off today. Woot woot! I'm still anxious about it. But trying to read through all these. :)

Hi Jim,

Reposting my question in hopes of finding help.

While on vacation on February 28th we made the mistake and purchased. When we got home March 2nd, thankfully we realized that there was a 10-day period to cancel. We mailed out our letter and the binder with the tablet. With delivery we made it signature is required and as I've been tracking it arrived at the postal office today and was marked for redelivery scheduled for next business day and a minute later updated to "available for pickup".

I was under the impression that this would be delivered straight to the address of Westgate Lakes, LLC and now I'm wondering if they will pick it up? Has anyone had any experience in this? Why did it change? This is coming from Canada.
I'm worried this won't get to them and will be sent back to me... Any help would be appreciated!
 
Stop worrying. Assuming you sent it to the Ocoee, Florida address, it will be picked up and the rescission WILL be processed they know better than to mess with this law.

That said (again) keep your postal receipt.

The date that matters is the postmarked date, NOT the date your letter is picked up.

A sure sign that they got it is when some sales weasel calls you to try to get you to reconsider. Don't answer. Thay can be very slick and persuasive.
