Help! Sent rescission letter to Blugreen

So on September 15, my wife and I were talked into buying a Bluegreen timeshare but after finding this forum we decided to back out. I sent a rescission letter on September 18 as an priority mail express through USPS and the lady at the front desk said it would be postmarked and certified mail. However, when I checked the tracking number today, it had said Out for Delivery in Boca Raton but now says Available for Pickup. Does that mean it wasn't delivered or signed for? What should I do?
 
It matters when it was postmarked. You should be fine. Keep your receipt for several months, just in case. I still have my return receipt from a timeshare purchase we made in 2007. I don't know why I kept it in my records, but I did.

Will they know to pick it up from the post office? The tracking number didn't say anything about attempting to deliver it to the address.

DON'T waste your time worrying about "when" they pick it up. They will pick it up today, next week, or next month.

It is the Postmark date that actually counts, so if you mailed it within the legally permitted time then you are all set. Rescissions can take as long as 45 days so just sit back and relax. Know that you have evidence of the date of mailing and that is what counts.

Now, think about buying resale, and becoming a member of TUG.....

Thank you and I definitely will. My wife and I are definitely interested in buying a timeshare in the future, and after finding this forum. We now know we can save a lot of money through the resale market.

Haha I will! My wife and I have already been doing more research on what timeshare we want to purchase for the future. We do our best to vacation at least once or twice a year.
 
New question I haven’t seen yet:
Letter sent, credit card refund received 9/10
We just received a letter stating they still have not received our voided check to start processing automatic payments. This letter was dated 9/12.
Should we be attempting to call them or is it safe to assume the cancellation has not taken effect prior to that letter being sent out?

I think it's just oversight that the debit people just didn't get that the rescission is in process. Go on with your regular life.- Except for the celebration!

My wife and I are definitely interested in buying a timeshare in the future, and after finding this forum. We now know we can save a lot of money through the resale market.
Another option you might want to investigate is renting from current owners. It allows you to "try before you buy". There are a number of advantages to this:

1) There's no upfront cost other than maybe the small cost of joining TUG or Red Week.
2) You can "try before you buy". If you find out later that owning a TS is not right for you, it's easy to get out of.
3) If one or more years you want to "exchange" (IOW, you don't want to vacation where you bought), there's no exchange fee and no membership fee to the main exchange companies (RCI, II, etc.)
4) If you want to do a different vacation one year such as a family camping trip or road trip, you don't have to worry about depositing your week or renting it out to recover your MFs.
5) You can often rent for less than what the owners there are paying in MFs. TUG has a Last Minute Rentals section where you can possibly find a rental no more than 45 days away for $800/week or less.

But on the other hand. Having vacation plan for 9 months makes it seem like you're already on vacation!

Timeshares also force you to use them and learn about them. The $2-7k of skin in the game is so motivating!
 
I always recommend sending a second letter using standard USPS first class mail. Just a stamp. They can’t decline that letter. There is no need to ever send priority but return receipt or tracking is good piece of mind.

That's a great idea. I'm going to send it tomorrow. I've already sent a copy of the contract with the first letter. With this second one I typed that it is the second attempt to notify them of my rescission.

They will charge you about $1.50 for it, and the recipient will have no idea you mailed it this way. The Postal Clerk will provide you with a Postmarked Receipt.

MOST people have never heard of a "Certificate of Mailing" but many lawyers (and others) commonly use it.

The envelope itself will reflect 66 cents postage, and the Certificate of Mailing will reflect the $1.50 expense under the Postmark. They will provide you with the Postmarked PS 3817 Certificate of Mailing showing the date you mailed it.

I just realized, when you all said Postmarked, do you mean the date that's on the receipt I received from USPS when I shipped the letter? Also, the receipt you mention is the receipt from USPS correct? Because I have that and the receipt I received from USPS also has the date it was sent with the tracking number.

Thanks for the advice. I just sent the second letter as certified mail and received a receipt from USPS and a tracking number. I know I shouldn't worry but I just want to make sure they get it so I can get my deposit back.
 
Unfortunately I was unable to get a hold of a clerk to send it as a Certificate of Mailing. I got off work at 6 pm and most post offices close at 5 pm
 
When you decide what to buy, buy resale and don't buy Bluegreen just because it's what you were going to buy directly from the developer. I wouldn't buy anything that I bought before 2008, specifically our first purchase in 1981 to our 2008 Wyndham. Used to love Wyndham, but they changed the rules on us for renting, and they are treating resale buyers badly too.

Be sure to look into anything that exchanges with II, and I would consider Marriott/ Sheraton/ Westin for a purchase.
