Hi all -- now that we're getting older and our son is an adult, my wife and I want to make provision to transfer it to him without probate when the second of us dies. Hawaii instituted a Transfer On Death Deed in 2011, according to what I read online. Websites like deeds.com will sell you a form or two for $28, but of course it is entirely DIY and I suppose the forms are free from the state anyway.

Has anyone done this ? Is it DIY? Do I need a closing service to push the paper?

It's Marriott Waiohai, in Kauai, if that matters.

Thanks much

Interesting question… following.

Might be a question to pose to LT Transfers, to see what they know about it. I did a lot of Hawaii buying and selling over the years, and I've never heard of this kind of deed.

a bit more information on TOD:

Yeah, I have the information, and someone's sample forms. But to me doing your own legal work is like doing your own tooth extraction ... not advisable, and a big pain now or later ...

TS deeds are generally more complicated. Look for a HI attorney experienced in preparing deeds conveying timeshares to assist you.

I don’t think LT Transfers handles Hawaii TS anymore due to specific requirements there. I could be wrong, though.
