Got scammed now walking away

New here today. Ashamed to admit I got scammed by an exit company and now I’m just walking away. It’s paid off. We can’t visit our timeshare because it is in such disrepair. We tried to stay there in 21. Left after 3 days. Mold, filth, bugs etc. maintenance was no help during that trip. Got scammed by an exit company. Since we cant visit or use it (we have RCI but that’s been difficult to use and a couple of years ago our timeshare was suspended from RCI for a while). It’s that bad! They just failed their level 1 inspection so our maintenance feels more than doubled. Over 2k for a place we can’t visit. I have never not paid a bill in my life so this is stressing me out. Anyone out there have the same experience? Thx
 
very sorry you fell victim to an exit scam

even more sorry that your only viable solution is to default...but it is the reality for many owners these days.

if you are just defaulting on your fees, there is little risk

 
Thank you. I feel like it’s going to follow me forever. My credit score. I’m older, but still worry. We wanted to move closer to my kids in a few years. We have great credit now. I guess we will see. This resort is small. They will go after us I think.

I've never heard o them before. Just out of curiosity, how did you come to know about this company? How did this company scam you? Was it one of those ones where they tell you not to pay and then ignore any MF bills and collection calls?

I didn’t find them. Relative going through the same thing referred. These companies tell you not to contact the resort. Forward all communications to them. We kept paying. They never told us not to. They probably wanted to. They really never shared their strategy. They maintained the timeshare was cancelled. Turned out it wasn’t. Now we are just done!

It's odd that you won't disclose the name of the Timeshare and where it is located...........

By forwarding all communications to them, it means you should also not be looking at the maintenance fee bills and paying them.

They can't get you out if you keep paying. They want you to do what you are doing now, walking away and not paying. The timeshare will foreclose at some point and they can say they got you out.

It's probably in Florida . Florida required level 1 inspections after the Surfside Condo fell apart. If a property doesn't pass the level 1 inspection it goes into level 2 where an engineers survey is required. After this report, the condo board has to make the repairs which increases the condo association fees which are spread out through the ownership.

I think this because the op said level 1 inspection and read something about the Surfside problem causing all properties with certain heights to go through this level 1 inspection in 2021.

Just curious if the relative had finished their "exit" or going through it - they had a good experience/happy with the result?

So it’s a very small timeshare. I guess you would say an independent timeshare. I’m just starting this whole thing so I worry that I shouldn’t say too much detail on a public forum. I have never done anything like this before. I’m worried about what they will do so I’m worried about telling details publicly. Honestly this whole thing has just stressed me to the max. I’m just not sure how much I should say. To be honest. I’m not trying to hide anything.

I suspect the property is already in a death spiral of owners, like you, walking away. Delinquencies are up, and that is why maintenance fees are also increasing. As fees go higher, more owners walk away. The property really needs to get some outside help to help right the ship or wind down the timeshare and sell the property.

It is unlikely that they will come after you to attempt to collect. Sure they may have someone call you asking you to pay. They will send letters and may file a lien against your timeshare deed. They can't file any liens against your other property. They can go through the foreclosure process to take the timeshare deed back. That is the extent of any action they will do. There is also a high chance that they don't even attempt to collect or foreclose. They may not have the money to bother with that. They just keep levying bad debts to the owners who continue to pay.
 
Well that makes me feel better. Thank you. As time goes on and I feel more comfortable, I will share more details. The property is dilapidated. I don’t imagine at this point they will ever get ahead of those repairs. Huge structural issues, plumbing, hvac and who knows what else. They had an opportunity to sell a few years back and didn’t do it. Smh.

Do you know what happens to the deed? If they never come after or foreclose. It just stays in my name? Or if they liquidate under a foreclosure; do they come after owners delinquent or not?

If the timeshare HOA never forecloses, then it just stays in your name. As for long term, if they never foreclose, it depends on how the property gets dispositioned. If they shut down as a timeshare they could ask owners to vote to sell or they could go through a bankruptcy process.

And I suppose if the HOA just ceases to exist at some point then the property eventually ends up in a tax foreclosure.
