Our daughter and son in law just celebrated their first anniversary. They were married in Washington DC and have been in contact with their photographer off and on (he sent the proofs and they made all final selections for their album and then communication stopped). They tried to call this week and he has relocated to Naples Florida and is not returning phone calls. He was paid $6000 and we have nothing but a DVD ( thank goodness they have that). Any suggestions? We paid by check so no going back to a credit card company.

Your only option may be to contact an atorney. An investment of a few hundred dollars for a legal demand letter to be sent may save that $6000 investment.

I can't tell you how many newly married couples I know that never got their wedding pictures after paying the photographer. This seems like a fairly frequent event.

That is terrible. Do you know his Florida address?

I would be some upset! I hope there is some way to retrieve your funds, though it does not seem hopeful. Good luck in dealing with this.

If the photographer is still doing work in Florida, I might file with the BBB there. If you are having letters of breach of contract drawn, you might also consider sending informational letters to wedding planners in that area too.

I'm always leery of small businesses that want all the money up front. I'll happily pay actual costs of raw materials, and a modest deposit to show good faith with the understanding that the rest is paid on completion.

Good luck on reaching a happy conclusion.

At least you got the proofs. Are they on a DVD? If so, you can make an album with that while you work on legally recovering your money.

It may just be a slide show of low resolution imaged.

Do you still have the proofs?

I would surely contact an attorney and file with the BBB. This is clearly a breech of contract.

What about this? File a small-claims action where his previous office was located, where the contracts were signed, or where the wedding took place. I really doubt that he would come back to answer the small-claims action.

You would then probably get a default judgment.

With that, you would have the ability to lien "any and all" of his property, bank accounts, etc, to satisfy the judgment. (How about hiring a "repo" man to take his 80 thousand dollar Mercedes? Or taking over his house or condo? Or taking all of his camera equipment at a fancy wedding--just before the ceremony was to begin? ---I'm sure everyone at the wedding would be very understanding.)

Some people just "don't give a Da**" -- it is "me--me--me" !!!

Thank you everyone for your advice. We just found out that our daughter is not the only one missing her album. There are at least 30 couples who have posted to a web site about their exact same situation. Some have been waiting more than 2 years for their albums. The sad thing is that this photographer keeps taking more wedding pictures and I doubt that most of them will ever see a completed album. All efforts so far by all these paid in full couples have been futile. Certified letters are returned, lawyer documents not answered, BBB has complaints filed and everyone keeps emailing and calling and no response for anyone. We will keep trying.

Until someone (preferably near his location) sues, gets a subpoena served, and physically gets him into court, you, and all the others are not likely to get satisfaction. My guess is he doesn't have any money to sue for, and has no desire or incentive (since he was paid already) to complete his end of the agreement to provide an album. About the best you might hope for would be to get the raw photos he took and have a reputable photographer build an album.

Again, about the only way to stop this con artist- and that's what he is- would be to alert wedding planners about him. Of course, the cops DO bust scams or cons, but someone has to be willing to file suit.

Good luck. Hope your daughter can at least get her pictures or proofs.
