Feeling scammed!

Help! I am a sucker for high pressure sales and recently purchased at Tahiti Village in NV. I immediately had buyers remorse and used the provided letter of rescission from the back of the prospectus. I mailed certified and it was returned insufficient address! I used the address they provided, preprinted on the letter. It is missing a suite number. Of course we are now well outside of the 5 day rescission period. Am I stuck? Do I remail this letter and envelope with the proper dated postmark to the correct address? Do I include an additional letter? Thank you for your time.
 
Are you saying they didn't have the suite # on the letter? That is on them. I would give it another try.
 
I’ve never heard of a timeshare developer including a preprinted cancellation letter. If that is what you used, and it came back as returned by all means send copies of everything to the correct address. Include another note stating that you used their supplied form, which had an incomplete address and therefore was returned, and that you expect your rescission to be honored.

I would be surprised if they challenged your rescission.

I would suggest you make a Xerox copy of that returned envelope indicating it was returned for insufficient address. You may need it at some point down the line to support your position that you did in fact mail it to the address provided within the legally allowed time frame to the provided address but it was returned due to "insufficient address".

Retaining a paper trail will boost your position that you followed their instructions (including the incorrect address) should you find you have issues obtaining your rescission request.

Hopefully they'll be no further issues and you won't have to worry about it, but if you do you will be prepared with exactly what you need. By the way, should you need to pursue this further (if they won't honor your rescission request) you will want to contact the Consumer Protection Division of the Atty. General's office in Nevada.

Keep copies of everything. So sorry you are dealing with this because the company was dishonest in not giving the suite number in the cancellation information.
 
Westin Kierland sales office did the same thing to us last November, address had no suite number and no name of company in the instructions. We sent in rescission on an Encore package using the address listed in their material and added in "Westin Vacation Club". Fortunately, I was watching the tracking information like a hawk and when I saw that mailman did not deliver due to insufficient address, I looked up their address on the internet. The same address had Wyndham and Marriott Vacation Club call center and they had different suite numbers. It was inside 10 days and we went to UPS store to fax the rescission letter and also sent a new letter to Marriott Vacation Club with the suite number listed on the internet. We got our money back and this experience had let us to believe that Marriott Vacation Club has stooped down to the level of Westgate.
