I am interested in a timeshare listing on ebay. It's a first time Seller who has not provided clear answers to questions. During due diligence, if I find out that it's not what was advertised or there are title problems, are there any penalties from ebay for not closing the transaction?

I would steer clear of this one. Your intuition is telling you that something is not quite right...don't ignore it.

I'd also be hesitant to purchase. Is this a really unusual opportunity? If not, I'd wait for another opportunity.

However, if you're really interested in this one, I'd try to speak with the seller. There are plenty of tips here on TUG concerning how to do due diligence.

Ebay TS winning bids are not binding.

I will wait for another week to come along.

Thanks!

in short no, if you do this for multiple transactions in a year there can be penalties however if this is your first then no. because it is not a seasoned seller it can also lead to a exceptional buying opportunity. ultimately you will be guided by what your written contract states not what is in the ebay adv
