ebay purchase through Selling Shares / Resort Closings

I won an ebay auction for a 1 bedroom at San Luis Bay Inn in Avila Beach, CA.

I have been in contact with the seller/Selling Shares and the title company/Resort Closings. The person representing the title company has emailed me the purchase contract and requested that I send them the full amount in the form of a cashiers check. If I want, I can send the closing costs (aka deposit) amount via Pay Pal.

I have requested some additional information, including a copy of the estoppel from the resort and verification that this is a warranty deed and not a quit claim deed.

It was also mentioned by title company person I have spoken with that I may need to have the deed that is sent to me signed in front of a notary, (I had questioned whether or not I needed to have the purchase contract signed in front of a notary and was told that I didn't) but I wouldn't need to do so for the purchase contract or the other documents (e.g. Cover Letter, Genereal Provisions of Escrow Transaction, Marital Status & Tenancy Request and Closing Type Request Form).

So far I haven't received a response regarding the estoppel or warranty deed question.

Does this sound on the up and up to everyone? Should I be sending the full amount at this point? Or, should I just send the deposit, $495, via Pay Pal and send the remaining balance at a later point? If at a later point, then when?

Pretty straight forward - just put everything in the PC - warranty deed, estoppel... everything that you want. You will need the title papers signed in front of a notary ($10). Send a resonable deposit - and full payment when everything has been taken care of to your satisfaction.

They are common eBay sellers - I did write something about them - but search it (blujahz, eBay, WSJ).

As to Avila Beach... my folks lived there a while back - beautiful area, but google (oil, "Avila Beach") - there was a severe toxic clean-up there (10+ years ago?) by one of the big gas companies.

I had previously found your posts as well as others here on the TUG website and read them about this company, I was satisfied that they were ok to purchase from and proceeded.

My question now was more relating to whether or not I should be sending in the full amoung at this point. If that is normal protocol to send the full amount in with the purchase contract, then I'm ok with it.

I have bought several timeshares from this seller in the past. They won't rip you off. Sometimes things go slow with the closing, but it happens with them all.

I have always sent full payment up front

I sent a deposit - then when the agreements in the PC were acceptable, and all the paper work was finalized - I then sent the rest of the funds. I did this because I was be cautious due to the unit being in the USVI, and the my research on CR and GoVacations (sellingshares). Everything went fine and actually relatively quickly for the USVI (about 6 weeks). RC was very responsive.

I'm going to proceed with sending the deposit and once everything appears to be in order I will send the rest.

Let them know that - it should be part of the PC.
