I bought a timeshare for $1 on Ebay in mid November of 2008. It included all the typical closing fees. They billed me immediately $350 for the closing and then the $650 maintenance and $125 transfer fee was going to happen later.
After not hearing diddly I got an email late in December from the closing company that said I should get the deed within 4 weeks. Its now February and I have not received one thing and cannot get an email, answered phone, callback, etc from the closing outfit (Timeshare Freedom) I looked online at the Riverside county website and did a lookup of my name and sure enough I come up as an owner of such a unit. I immediately ordered my own copy of the deed which arrived in two days. I also noticed that on January 17th that the closing company charged my credit card for the 650 maintenance fee. I called owner services of the resort and they still have received nothing in regards to payment or ownership transfer. Would it be out of line to step in mail the deed, pay the maintenace and transfer fee and apply the closing company money towards the next year to finalize the deal. I need to get it done to reserve a march week in 2010 that go like hotcakes.....
Looking for thoughts on the matter.

I know its long winded but..........
 
I suggest that, before you do anything, you send the closing company a demand letter by certified mail saying that, unless they complete the closing by date 'x', you will proceed as outlined, and that, if they have a problem with that, they must contact you before that date.

Timeshare-freedom has very inconsistent reviews here on TUG. It was their messing up my eBay purchase that brought me to TUG in the first place. If you have been dealing with Tammy, and getting no response, try moving up the ladder to Sarah. If they provide no relief, contact Darren Gibson. Although Darren is not directly connected with TF, he is above them in the chain of command.

PS. not sure if any of the supplied emails are still active as it has been some time since I had to use them so they might bounce.
 
I have sent emails to all addresses listed. Hopefully I will hear something. I talked to the timeshare units today and there is a problem with the deed. Timeshare Freedom was listed as the owner and the new timeshare people said that they would need to know who the real owners were.....

I am tempted to call my credit card company and dispute the charge of the maintenance fee. Maybe this will require them to come out into the light.

Grasping at straws to complete this transaction.
 
I suggest that you determine when the deadline is for you to dispute any CC charges with them and submit a dispute in writing (or online, if provided) at least 10 days b4 then. You can always back down if they come thru.

But again, absent a contractual provision to the contrary, your written notice to them of your proposed action, and their failure to object within a reasonable time, can be construed as an acceptance by them.
 
Not sure when you emailed them but if the emails did not bounce and you haven't heard back within the week, I would send them an email stating that you are going to dispute the charges and do so.
 
Got an email response from Sarah She stated yesterday, she said their staff was in meetings all day and someone would contact me on monday to sort it out. So it looks like they have bolted the doors which is my biggest concern. I faxed the deed i procured on my own to the timeshare (Trading Places) and the book keeping department told me that there is an issue with the deed being transferred from Timeshare Freedom to me. They need to know who the owner was originally..... So we have to work through this glitch doesn't seem too hard to me if they would just pick up the phone and do it
 
i also noticed that all the charges have been made to my credit card. I paid the $125 transfer fee with the closing fee in the beginning installment in November and then they charged the maintenance fee on Jan 7th

Which means that there must be another deed or perhaps a power of attorney (which the resort does not know about) in which the owner gave Timeshare Freedom the title or right to sell the TS. Absent that, there is no proof that Timeshare Freedom ever had title or any rights to the T/S. I'd try to find that in the public records where your deed was recorded (if, that is, it was recorded).

Hopefully the deed wasn't transferred to Dharmesh Patel, if so, this could take some time to clear up.

If you have a copy of the recorded deed, you can send it to Marriot yourself - they don't have to get it from the closing company. If not, you should be able to get this info. from the County Recorders office, where it was recorded. The MF, however, is a whole different issue.

What state is it and I will try to find the website for you.

Hi Denise,

I just ordered a Certified Copy of the Deed from Riverside, CA County. My credit card was charged on 1/23/09 for the Maint. Fees.

I don't know how long to give Timeshare Freedom before I initiate a charge back. Plus back taxes for 2008 are due, granted it is only $76 but it all adds up. Thank you for any advise!
 
Marriott can take 30-45 days to make the change once they receive everything & Riverside County can be slow to return deeds so you may just be waiting for everything to fall into place.

Marriott does take 30-45 days to record but once they receive the paperwork it is logged that is has been received. This is done immediately upon receiving transfew paperwork. No paperwork was received for the unit I purchased. My deed was recorded on 1/13/09, surely it was received back to Timeshare Freedom the week after recording.

I don't have a problem being patient, if I had more information as to where the hold up is.
 
I filed a case with the Better Business Bureau of Atlanta. Here is some info I got off of the website regarding Timeshare Freedom.

:bawl: On December 11, 2008 this company's accreditation in BBB was revoked by BBB's Board of Directors due to engaging in activities reflecting poorly on the BBB or its accredited businesses.
 
Don't know if it was coincidence or not but after filing a complaint with the Atlanta Better Business Bureau, Desert Breezes received all the proper paperwork and they even responded tothe better business bureau to refute my claim. Either way, I am a happy camper because the resort today has me as an official owner. Have to wait a week for Interval to get our unit in their system before we can deposit. Looks like the light is at the end of the tunnel

This is the classical case of impatient pain. This should work out for you. Marriott is experiencing problems with the economy like all business. Just hang in there.
