Capital Resorts sues Wesley Financial

Was only a matter of time before this happened, though im shocked it was Capital Resorts that finally did it vs one of the other players.

Shall watch this one closely for sure and based on the outcome would expect similar suits from different states.

 
This is what the American Resort Development Association (ARDA) should have done a long time ago. If they had, I would have been more inclined to pay the fees they sneak onto our maintenance fee bills.
 
Not to mention, Chuck McDowell ran "VO Group" which was sued out of existence for the same fraudulent business practices! He obviously never learned his lesson.

Sadly, my guess is that those ARDA contributions paid by timeshare owners are used to cover the weekly “Mexican Fiesta” office luncheon, and nothing more.
 
Mike Flaskey said in an interview that he didn’t think any of the hotel brands would ever take on these types of suits. So that leaves the independents like CV, Westgate and a few others to fight them.
 
Does Capital Resorts have an exit programs for its owners?
NO it does not. It manages a resort we used to own and still visit/keep up with Bluebeards Castle USVI. They do offer a list of units Owners have for sale, that you have to ask for if your at the resort. The individual HOA's may take back a high season week then rent it and offer it to lease for a fee plus you pay the maint. fees

It sounds like you didn't own through Capital Vacations. You owned an independent resort that was managed by Capital Vacations. If you "upgraded" to their points program, you would have been an owner with them (NOT RECOMMENDED) and you would have been able to use their exit program. Since you were an owner of the resort directly, it would have been up to the HOA if they wanted to offer an exit program.

Yes that is correct , just the management for the resort.

Just had a call/proposal with Wesley yesterday about exit possibilities on our timeshare. Is it wise to just stay away from them and any exit companies (and just try to find someone at timeshare to see if deed buyback can be negotiated)?

Yes, stay away from exit companies. Their first step is going to be to contact the timeshare company or HOA to ask for a deed back. You can do that yourself for free. They have no magical potion or power to get you out of the timeshare.
