Cancel Palace Elite membership

Hi all, I stayed at Palace Resorts Sunrise between Dec 21-26. I signed up for Palace Elite membership on Dec 22nd. I agreed to attend their tour as they were giving Day-pass to The Grand as incentive. During the sales pitch, they gave me 40 weeks membership at a lower rate than what they originally quoted and also gave me 3 day Day-passes for The Grand between Dec 24-26 and also $150 in Palace credit for use at the resort. The selling point during the sales pitch was that I would be able to recoup the membership fee using the 7 Nights free stay at The Grand. I got back from signing and did some research and realized that it was not really a good deal. I sent an email to memberservices@palaceelite.com.mx, CCed Profeco on Dec 23rd informing of my decision to cancel membership and request a refund of the down payment of $3600. I also wrote a short letter informing the same and delivered personally to the Palace Elite Center on Dec 24th. I also took a picture of the letter and sent it as an attachment to memberservices@palaceelite.com.mx and Profeco. Got a generic reply from Profeco regarding my right to cancel membership within 5 days.

Palace Elite got back to me on Jan 2nd informing me that my membership is being put on hold. They also mentioned that I have enjoyed the perks of membership. I replied mentioning that I have given all the reasons why I wanted to cancel membership in the previous email sent to memberservices@palaceelite.com.mx and Profeco. I attached a PDF file of the previous email. I also rejected their accusation that I had enjoyed any perks of membership as I didn't visit The Grand or enjoy its amenities and neither did I use Palace money credit.

I got an email from them on Jan 7th mentioning that my membership is inactive and that an administrative charge has been placed on it and will be referred to legal area. She offered to reactivate my account with no additional charges if I replied "OK" to her email. I replied politely that I have already requested them to cancel membership and attached the PDF file of the original email I rent requesting for cancellation.

In the meantime, I have already disputed the down payment charge on my credit card with my Bank. I have sent the contract, payment proof, copies of email communication to the Bank by mail. The claim is under process.

My question is what else do I need to do? What can I anticipate? My main concern is on my credit score as I want to refinance my home in 2-3 yrs time when the rates go down a bit. I have heard that they might transfer me to collecting agencies who would harass me and my family.

Follow up with the CC issuer to regain your $ 3600

Thanks for reply. While it makes sense that Mexican companies can't report to our agencies. The Collections company would be in USA and they can report to our agencies right? This is just a thought as I want to be prepared for any eventuality.

@RR2024 - I am not an expert & most of what I know on this topic I learned reading TUG.

I don't believe a USA collection agency can report a Mexican debt to a USA Credit Reporting Agency.
What the bottom feeders do is buy packages for pennies on the dollar & hope they can bully some into giving them money.

What I have read is that if you are called - you should never acknowledge that a debt exists.
Primarily in this forum ; this is for someone who has a fully paid for Mexican TS and decides to stop paying the annual MF because they are not using it.

There is no law that says Palace cannot play the games that you have posted about. However the credit card company should ultimately reverse the
$ 3600 transaction because you have a legal right in Mexico to rescind within 5 business days.

I too got sucked in on Saturday.. I can’t understand the Profeco site. Can you please share the email? I was told up to 60% and my account is showing 20-35%… I can’t get that through 3rd party without paying the $20,000

This is Profeco's email, extranjeros@profeco.gob.mx They actually replied to me mentioning the relevant law points. This might be useful info to hve when we dispute the transaction with the bank.

If you signed a purchase agreement on Saturday, January 6th then you ONLY had until Thursday, January 11th to legally rescind on your own.

I am not sure what you expect PROFECO to do for you other than confirming that you are beyond the legal rescission time. You're an owner!

Oh they will be nice indeed. They will play good cop and bad cop. When I went to deliver the cancellation letter in person, the original salesman was all sweet and mentioned that he was sorry that I was disappointed and mentioned that I could try my luck by emailing them. He of course offered me advise to "spare me of the trouble and disappointment" that it would never get cancelled and that my best bet was to stop paying for monthly installments and then Palace Elite would cancel membership. I knew that all this was BS as nothing stops Palace Elite from coming after me for monthly dues even if they are assured to keep the downpayment. I shook hands with him, smiled at all the cameras in the ceiling and left the place.

Has anyone ever successfully cancelled Palace Elite membership and recouped all their money successfully?

Look at the cancellation section on your contract. Follow what is written there. If they give you more than one option, use it. Keep records. Take a copy of the same letter and go to the post office and send it via registered mail if you are still within the time frame. Keep a record of that too.
Then block your card, give them a about a month to refund your cars. If you don't get your money within 45 days, initiate a dispute with your credit card company.

They will call you or email you to offer something to get you to stay. Don't bite.
