Canada Notary or US Notary

Hi everyone,

I’m new to this forum. I found this forum a few years ago, but only recently been reading it more frequently. I’m in the process of a Certified Exit and I’m waiting for my documents. My question is I’m Canadian; does the US accept Canada notary or does it need to be notarized by a US notary?
 
Documents notarized in Canada are not considered properly notarized in the US. There are a few ways to notarize documents for the US:

1. Drive over the border and find a US notary like at a UPS store. $15.

2. Make an appointment at a nearest US consulate in Canada and notarize there. $50.

3. Notarize with a Canadian notary, and then go through either provincial or federal authentication process. Very long, and costs about $400.

Thank you so much, Echino! #2 & #3 look like a headache. I better renew my passport. I’m assuming you’re from Vancouver, BC? If so, me too!
 
It may also be possible to notarize virtually on a website like www.notarize.com (which uses a U.S - I believe Virginia specifically - based notary and everything is done on video).

I will caveat that I've only recently heard about these services and have never used it myself, so no idea if this will "work". If you end up using it, please report back!

Depends. I've used Canadian notary for several transfers. Once i had to go to the US Embassy though as Hawaii required it.

edit to add: It does look like this service may require you to be a US citizen or resident ((just traveling or living in Canada). they require a US SSN to verify identity.

This is not entirely accurate. It depends on the state where the property is located. I have transferred timeshare properties in AZ out of my name using a CDN notary. California and Hawaii do require the notary to be registered as a US notary specifically.

When borders were closed during Covid and I needed a US notary for a signature on a US timeshare deed, I looked into online notarization and it did not work. The state where the deed would be recorded must specifically allow online notarization (the state in my case did not allow that), and also during online notarization I must be either physically present in the US, or be a US citizen/resident if outside of the US. So it did not work for me as a Canadian. I ended up doing a consulate notarization.

Unfortunately, this service doesn't work for Canadians :(. They require the individual to have US ID to verify. It looks like it is designed for US citizens to notarize a document while abroad, not non-US citizens trying to notarize a US document

Yeah, I updated my post to indicate that. I suspect most online notaries would be the same.
 
Ok, my head is spinning now. Thanks for everyone’s replies so far. I found a notary where I live and on her website she states that she is registered with the US consulate for execution of American documentation. I would be able to have her notarize my documents, right?

That is option 3. Yes, you will be able to notarize the documents, but then you will need to go through the authentication procedure. It's very long and expensive.

Interestingly, Disney Vacation Club does use an on-line notary for their resale purchases and it works well. That said, I usually just go to my UPS Store when I need something notarized. They are in most U.S. cities and all the ones I have been too have notaries.
 
UGH! So sorry our Canadian friends have to go to such lengths to get something notarized for your Timeshares.
 
Hi all,

Sorry to piggyback on here but would like to clarify - I'm a Canadian purchasing a Hawaii timeshare and my escrow documents state that I need to do eccino's options 2 or 3. I'm over an hour from us consulate in Vancouver but wouldn't be the worst. I do however only live 10min from US border so going to a US notary would be much easier. Do you think they just don't state this as an option as they assume no access to this? I of course can ask my people but was sure many of my fellow Canadian (or international) Tugger's have been through the process before...
 
Going to a notary in the US would be fine.
 
Hi Everyone,

I just want to update my Certified Exit journey. I am FREE from being a timeshare owner! I couldn’t be more happy this chapter is finally over. I was a SVC - West owner with very little points to travel every other year. I called Shell on May 16th and chose the Outright option. They told me it would take 9-12 weeks for the documents to arrive and another 9-12 weeks to complete. In 6 weeks on June 26th, I received the documents by email via DocuSign and it couldn’t have been more easier than that. Notarization was not necessary. It was signed and returned the same day. Today I received in the mail a letter confirming the completion. It was dated August 16th so it took exactly 3 months to complete. The waiting was the hardest part, but I’m happy it’s over and done with. I have a lot of memories from all the trips we took and will cherish them all. I won’t miss the owner’s updates. The last one we went to was at the Kauai Coast at the Beachboy in April this year. She told us for $14,850 we could get an additional 6500 points. No thanks! She also told us 85% of Shell owners have converted to Wyndham and that if we didn’t convert we would be the last ones standing and we would have to pay the maintenance fees. And, she said we are stuck with our timeshare for the rest of our lives! The look on her face was priceless when I told her no we weren’t going to take out a loan or buy more points because we knew we could get out of our timeshare.

Congratulations! We gave back our tiny SVC Hawaii ownership a couple of years ago and are SO happy we did!
