Bad Renter Warning

As some of the posters have deduced, Bolduc lives in Sandy, UT and has an 801 area code phone number
 
While many folks do business w/o written contracts, this situation and other
disputes are far less likely if there are at least some written understandings,
such as...

-- No cancellations, no refunds. Trip insurance (tenant's) covers emergencies.
-- Landlord to be held harmless from claims for damage or missing items.
-- Premises are "as is." No guarantees as to personal comfort or contents.

What's so hard 'bout that.
 
As a side note, a good friend of my wife and I rented out their timeshare (I don't know where or what company it's through) to a person, the person paid by check. As you could guess, the check bounced. He said the time and effort would've been too much, so he decided not to try to get it back.

PayPal is probably the best option. Cash is good, but you would need to be at the resort to collect it. And a simple contract that says the renter must talk to the resort for any issues.

We recently rented a timeshare (Eckhert Place) in San Antonio to Barry Bolduc. He has filed a chargeback on his credit card/Paypal because he was dissatisfied with these aspects of the rental:

- Not enough toilet paper
- No spices in the kitchen
- Swimming pool was too cold

We feel these reasons are just a bit picky, and we will avoid renting to this person in the future. We thought other Tuggers that rent their timeshares might want a heads-up. Make your own decision, of course, but learn from history.

Hope it works out for you. Was this an e-bay transaction? If so post his user id!

In many states, worthless checks can be prosecuted as a crime.
It can take a long time and payment is iffy, but its not difficult.

You send a notice as prescribed by statute, usually by certified mail.
If the check and the statutory fee is not paid, you turn it over to the
local prosecutor who will file charges and enforce payment for you.

I do not understand this. I do not know of any place where the local district attorney or equivalent does not have a "hot check" division.

Here in, (I guess it must be) Mayberry, the DA has a staff of about 4 people as well as every misdemeanor DA - about 15 attorneys - working on hot checks.

I agree; here in Spokane (Mayberry North) the prosecutor Steve Tucker even gives shop owners a personally signed (with picture) sticker to put on their cash register.

In essence it says: "if you kite a check around here I Steve Tucker will chase you down and lock you up for a loooonngggg time".

Whateves dudes and dudettes :cool:
 
Barry Bolduc Update

I'm sure you'll all be pleased to know ...

Those beloved one percenters at the credit card company sided with Bolduc and refunded him $250 for the cold swimming pool (and I'm told the spa also wasn't hot enough), missing toilet paper and spices, and ... important update ... he also had to visit the office for new TV remote batteries!

PayPal is supposedly contesting the results with the credit card company ... I sent them additional information today that the resort gave me about Bolduc's monumental troubles ... in addition to the batteries he also had some confusion on the confirmation (he called a few days prior to check-in and the resort did not have his name ... it seems the exchange companies often do not update reservation information at the resort until a few days prior to check-in) ... so this apparently caused extreme emotional distress.

I appreciate the life Tuggers have given to this story. It is funny (and very appropriate) that Googling Barry Bolduc Bad brings up this thread. It's not nearly as demented as Googling Santorum, but seems just desserts nonetheless.

I'll post an update when available. I'm thinking that the resort and exchange company owe me money, if this dispute stands. But wish me good luck getting it. Us 99%ers, we are used to bending over and grabbing our ankles (thanks for THAT mental image, Rushbo).

:eek: I know it happens, but not the smartest thing to admit to. Best to never bring up Barry Bolduc again....:ignore:
