Good afternoon...

I thought I went in with my eyes open> However my husband And I bought in 2018 at Westgate in Orlando. I found you way to late.... ;) However our property still has not been deeded to us. When calling today they indicated it would take up to 2 years. This is insane. I would will house closing and they try to convince me that Timeshares were different. Are we being scammed. I have also requested twice a statement of my principal and interest payments.
Does anyone have a good lawyer in Florida who can help us cancel the timeshare?. We are in the position to payoff but again they got us on the HOA fees and I think they are too high. SO we rather walk away and find something more permanent or property with lower HOA. Current HOA is 1000.

We were deed our father in law property in the Cape Cod and the HOA are 1/3 .. which could be location. Any advice would be helpful. WE are heading to florida in March and would really like to find some answers.

davidvel: I believe crounds is comparing the cost of the MF in Cape Cod, which they inherited, to the cost of the MF at the Westgate, which they bought in Orlando.

crounds: Welcome to TUG. I'm glad you found us now. Are you saying that you bought in 2018, but you never received the deed? Have you been making loan payments? Have you been paying maintenance fees?

Check this website. Put in the date range of when you signed to now. Put your first and last name see if it comes up

If you still have a loan on the timeshare which it appears you have, it is normal with some companies that the deed will not be recorded in your name until the loan is paid off.

I have no idea what the last paragraph says. In order for us to help you, you need to convey very clear language.

it sounds like you might be getting scammed. Even with a loan, you should have a deed notated with a loan.

My very first purchase.... I didn’t receive a deed for years. Granted it was in the Bahamas and it was a developer purchase but it literally took years. I almost forgot I was supposed to receive a deed.

I think in that last paragraph they are trying to say they inherited another timeshare in cape cod and their maint fees are 1/3 of the Orlando property. They are assuming it’s due to location? Which doesn’t make much of a difference as it does a HOA association and other factors. I’m from NYC, I understand fragmented sentences haha. We speak quickly and leave things out, ha.

For my first rescinded developer purchase, I was to receive a deed with loan info notated. Laws may be different in FL. Also, Westgate is a notoriously bad actor.

Yeah I’d steer clear of Westgate as much as I can lol. I wish I knew about TUG before buying Harborside at Atlantis developer. Wasted money lol

Thank you for responding. I was posting via my phone. I did find an attorney to offer a free consultation. However, My husband and I know since we do not know any Florida lawyers this comes with its concerns of being scammed a new way.
My most immediate concern is to find a reputable lawyer in Florida to understand the laws.
The property in the Cape was deeded to us by my father in law. Since the HOA fees are extremely low we will keep this property.

Has anyone been able to renegotiate HOA fees? The fee with Westgate is 1000.00. I am pretty sure this is on the high end.

Any additional information will be extremely helpful.
We were considering approaching Westgate and asking them to reduce the HOA. We are in the position to pay off the timeshare but will not and considering working with a lawyer to somehow remove our interest.

Yes I am making loan payments and we are current. timeshares might work differently but when you purchase a home you are listed on record with the Registry of Deeds. The property is recorded with a lien with the loan holder.

I’ve never heard of negotiating HOA fees. It is what it is, I’d suggest once you pay off your loan you try and give it away free. Or, make use the the ownership.

Yes, I agree. The OP "may" be able to negotiate his/her loan, but will not be able to negotiate the HOA fees.

Maintenance fees are not negotiable. What size unit did you purchase at Westgate? The larger the unit, the higher the fees.
What size unit do you own in Cape Cod?

Have you been receiving any mail from Westgate? The maintenance fee bills?

You cannot negotiate HOA/MF. HOA/MF is computed from what it takes to take care of the unit, divided by whatever fraction, a week would be 1/52.
