OP stated in the first post that she was willing to pay legal fees to get out of paying future MF's. Giving it away and paying the transfer fee seems like a win-win for everybody.

I only wish people would find TUG before they dig into a big financial hole with their timeshares.

I currently have a timeshare with Raintree that is expiring at the end of this year. I have about 50,000 points. I was told that I was unable to use these points to go skiing in January as my timeshare will have expired at that point. If I don't use it then I will effectively lose it. I was told, however, that I can transfer my points for free to somebody and have him book my Vacation in January.
I need approximately 80,000 points in total and I am willing to purchase 30,000 points from somebody if somebody is interested. I would transfer my 50,000 points and added to their 30,000 and have them broke my vacation for me. Please let me know if anybody is interested in selling 30,000 points

About taking a hit to one's credit rating -- I hear that assisted living facilities and nursing homes do care about credit ratings, a lot. So, the idea that an older person no longer needs their credit rating may not be true. Also, in many states, the cost of auto insurance and homeowner's insurance varies tremendously, depending on one's credit rating. I'd be very careful about anything that might hurt my credit rating. And, as others have noted, this may not actually be a Mexican timeshare. The building may be in Mexico, but the management company may be in the US.

If this is an "Emerald" Raintree Vacation Club membership, someone will likely want it. I don't know much about the non-Raintree Club Regina ownerships, though.

It sounds like you have 160,000 point membership. Please find out the definite date that membership expires and whether it is Club Regina or a Raintree Vacation Club membership. Then I could reach out to people I know personally who may wish to accept your membership. How many points have you accumulated that have not been used? With this information, I can reach out to prospects. I do not charge a fee. I am just trying to help people who love being in warm and beautiful places during chilly northern winters.

I purchased a Gold membership in 2005 for one week every other year at PV at Club Regina on even years. It's paid in full. I've never been able to go and have been trying to give it away since 2012. If it's just a membership, usually you can stop it by just stopping payments. There is a thread in the Mexico forum about what can/will happen if you just stop paying.

The problem With gifting your membership is probably the cost of maintenance fees for amount of time you have available to you.
I will be going to PV in a couple days and if I find a taker for your membership, I will let you know.
You will probably need to ay transfer fee and maybe a year’s worth of maintenance fees to attract a taker. Also, how many points that you haven’t used can transfer to a new member?

Re: your dilemma, Mexico vs. Arizona. To make this real simple. If there is a deed for your property, it's U.S. If there is no deed, it's a Right To Use, therefore, Mexican. They might put on late charges, but the only 'teeth' they have is to take away your use, and that's what you want anyway.

If it was me, and it's a RTU, I would default and not look back and happily throw their notices in the recycle bin.

I think you can just stop paying. There is no deed to foreclose on, and once they realize you've stopped and losing the right of use, they'll stop writing. I can't see that defaulting on a Mexican timeshare would have any effect whatsoever on your credit. Miss it goodbye and remember the good times you had there. DO NOT sign up for ANY upfront fee outfit. Mexican TSs have instituted unreasonable transfer fees, so even giving it away is nearly impossible.

Sorry for your health issues, we're all headed in that direction.

She may (probably will) get letters that if she doesn't pay, she'll lose the ability to use the resort, but that's what she wants anyway. Don't lose sleep over this. It won't affect credit.

I wanted to get out of my Raintree Vacation Club timeshare due to its outrageously increasing fees and our growing unhappiness with the property. I have tried selling it for peanuts--foolishly paying money to do it--with no success. When I tried to give the thing back to the resort, they refused. Then in 2020, I was duped into "upgrading" my account into a new kind of membership that included the promise that after two "skip years", where I was allowed to skip paying maintenance fees, I could end my relationship with Raintree Vacation Club. Dummy that I was, I accepted a verbal promise. Well, the two years are up, and now they're telling me I'm stuck with this financial albatross until 2030. These people are liars and cheats.

I then called Equifax and grilled them about what would happen if I stopped paying these ever-increasing timeshare fees. Here is what they said:
* Equifax does not report the non-payment of timeshare fees on one's credit report.
* If the timeshare debt is sold to a U.S. collections agency, it will report it.
* But if the collections ageny reports the debt as unpaid timeshare fees, Equifax will not report it on one's credit.

Thus the question seems to center on how RVC deals with the U.S. collections agencies. Does RVC actually sell the debt? Will a collections agency risk buying the debt knowing that it's for a timeshare and that the only leverage they have over their victims is to ding their credit? Elsewhere, I read that RVC uses three different collections agencies. If that is true, then how could RVC be selling the debt?

My husband and I purchased a Westin Regina time share in Cabos years ago (1997), 2 weeks, 2 bedrooms which is now Raintree Vacation Club. We were able to use it most of the time in the beginning, but for many years rolled it over to RCI and then the weeks would expire. It's become a nightmare. Fees increased and we can no longer travel easily to Mexico due to health conditions. Just want out. Does anyone have any advice. I would pay for legal help if I trusted they could end this scam. Apparently the contract is until 2026 or 2036 depending who I speak to. What happens if I just stop paying and never use it again? There must be some legal way to get out of these things???
