[ 2015 ] Just purchased Wyndham Timeshare - Need to Rescind

It's not a matter of hoping they will honor your right of rescission. They have no choice. But today is Sunday. The post office is closed. So write your letter. There are plenty of templates here and elsewhere. Make a copy of the signature page of the contract for ID purposes. Send it USPS Certified w/return receipt. The address is in Las Vegas, but not at the casino. If they put your down payment on their card, you'll want to keep it open until it's refunded, then cancel it.

Glad you found us in time to save yourself many thou$and$! Timeshares are a great way to travel, but are a lousy investment.

Me and my wife just purchased an ownership at wyndham yesterday. 02/09 We were at a casino in las vegas when all of a sudden these sleazy agents were telling us if we want free shows little did we know that they were already signing us up for a presentation/tour.

So we went to the tour we purchased 126k points with 174k bonus points plus 2 weeks rci free vacation. Plus they ran our credit for the credit card as well. I wasn’t really sold but my wife kinda got sold with you know bigger rooms and kitchen.

But I really really feel bad about this ownership thing. I feel like it’s not worth it. We always stay at hilton hotels and I feel like wyndham properties are cheap. And doesnt suit my taste aside from that I just feel like it’s not worth it.

We are still in vegas and I really dont want to go back to that building and hand them the letter to rescind the contract. I am already scared to talk to them. Can i just mail it to them here in vegas to avoid these discussions?

I really hope they will honor my letter. Thanks a lot!

I saw someone here in this thread using the other address the PO box one 94443 where it says wyndham consumer finance. Does it matter if I use either one of them? Im kinda confused now I dont want them to getaway with this

If it helps you sleep, send a letter to both of them. I am no expert, and have no inside knowledge that places one address ahead of the other. One tactic timeshare outfits use is delay. If they paralyze you long enough, their commission is safe.

Just wanted to let you guys know I truly appreciate the helpful information you guys provide here on your site. I too was talked into a timeshare recently and just got my rescission letter today. All I'm waiting on now is the deposit charge to come off my new wyndham card I had to sign up for.

Just little backstory, my mother offered her timeshare for a trip to myrtle beach for my wife's birthday to relax and do some shopping. They tell us at the desk as we check in "ohh hey your mom usually gets her free gift when she arrives would you like to claim it instead for her?" I figure why not they were offering $150 in food vouchers and we did want to go out to eat. They said only takes 90 min and said we could go the next morning and be in and out quick. This was my first experience with a timeshare so the idea of something for free was nice. Boy was I wrong.

We decided to sleep in and missed the morning "session". We were going to blow it off and go out to shop when the concierge lady came a knocking on our door. "ohh sorry you missed the meeting we really want to get you your presents, come at the next one at 11". We came back at 11 and ohh did they put on the charm. it was just ooozing off of them. we waitied 30 min for the speaker to get ready and others to arrive. OK 30 min down only and hour left. They do the presentation talking about RCI and Wyndham merger and all the great resorts meanwhile our "handler" was asking all sorts of question about our travel habits and kids and she was ohh so chummy. Then well we cant talk to the other person who talks about "numbers" cause lunch is here, how about free catered lunch. So at this point we were here past the 90 min and I had no information on how the program actually works just company merger info ohh and hey we are the only resort on Disney property!!!!!

So the numbers guy come to sit down cause our handler was only there to gather in-tell and listen in on what my wife and I were discussing to pass on to her manager. Oh did this guy lay it on, so many alarms going off but my wife was hooked and wanted to see what the deal was. He talked about being in a certain church which impressed my wife and a certain college and ohh how his kids loved the resorts. Hes throwing numbers 200,000 points, bonus points, rci vouchers. He realizes we were a family member of a owner already and ohh you get the red carpet now, VIP choice this , preferential that, a free kindle, a throw blanket. Part of the way thru I was having a high blood sugar issue and had to stop. That should have been my final red flag moment and we should have left.

In the end they and my wife talked me into a 84,000 point timeshare with 200,000 bonus points and 2 "free" RCI weeks for $16,500 and $60 maint fees. By the time I was done I still had no basic understanding of how the points system worked and I had opened up a $30,000 wyndham credit card and charged the down payment of $1700 to the card. The balance was a 14.99% loan for the next 10 years.

I tried while I was in there to look up some information to fact check and there was no cell signal. I told them no several times and even said I wanted to talk it over with my wife and come back tomorrow but ohhh no this is a one time special off, only good now, only good today. Your kids and your wife will hate you for passing this up....Pressure pressure the whole time, three different guys, ohh let me talk to my manager, ohh let my check my computer and see if it can allow this change and that, 5 hours of my precious vacation day lost, Ohh sorry 6 hours cause I got there at 11!! I walked out of there with the worst feeling ever just dread and hate and self loathing at what I had done. The wife was happy but I was miserable.

After getting back to the room and stewing over it I got online and started researching and finding a lot of complaints and similar stories to mine about how pushy they were. My wife was starting to turn against me on focusing on the negative posts. The rest of my weekend was ruined as I kept thinking it over. By the end of sunday I found the page in the contract that says SC has a 5 day rescission period to void contracts. It took me the next two days to prove to her how bad a deal it was and that they pressured us without giving full information. I google wyndham rescission and low and behold found the saviors of tugbbs forum.

I signed up on Feb,2 2019 , sent my certified return receipt letter to both addresses in the contract by Feb, 6 2019, and got my confirmation letter today Feb, 22 2019.

I cant thank you guys enough for the help you provided getting this burden off of my back. Without the information and success stories from your forum group I would have prolly not done this in time and would have hated myself for the next 10 years.

BTW are these 2 RCI week certificates worth anything to anybody? They are blank with issue date of 8/1/2018.

Just as another side note that makes me even more leery of them, is 2 weeks after this happened I get a Letter thanking me for opening another $30,000 line of credit with another wyndham "vacation club" credit card. I can't find anywhere in my contract paperwork where I signed up for two separate credit accounts. I did log into it to make sure nothing had been charged to it, which it hadn't, but i will have to spend the next few months watching the activity to see if they try to defraud me further in some way.

Others more knowledgeable than me will probably chime in, but I'm thinking you should cancel both credit card accounts. The Wyndham weasels talked my dad into applying for one back in 2016 when he was 90 years old and only wanted to add me to the deed for his two Hawaii weeks. Somehow it ended up that he would enroll those two weeks in Wyndham's point system and buy more points with me on the account for the low, low price of $20,000, charged to the new CC. He actually called the deal off before we walked out of there, but the CC account was still opened, and he had to cancel it himself once he received the paperwork after we returned home. No need for you to keep the accounts open if you're not buying a timeshare from them!

We just went through a similar story to many on here in Myrtle Beach on Monday. Late Monday night we decided that it would be best if we did a rescission. Wrote a letter using the one in the first post as an example. Called Consumer Finance and got a friendly person. She gave me the fax number. So we sent the certified letter today to the address on Charleston Blvd in Las Vegas. She said don't fax yet because it takes 24 hours at least to get us into the system. My wife was on pins and needles so we went ahead and faxed today. Is there another address I should send a letter to and do you think I should fax again tomorrow? I'll send faxes and certified letters until my 5 days are up if I have to. I just want out of this after all the things we've read. Thanks for all the info on TUG. It was a big help. Thanks,

You should have instructions in the owner's package you received that tell you how and where to send your rescission letter. Likely it will say certified mail. If that's what it says, then send it via that method.

I'm glad you found TUG in time for you to rescind.

Hi All,

So thankful I found you guys as my wife and I were also pressured into purchasing this past Saturday. We just sent our rescission letter today, which is 3 days after signing and in California we have 7 days to send out our letter.
When reading through our contracts, we found 3 different departments to send our rescission letters to: account servicing operations on Charleston Blvd in Las vegas, Worldmark by wyndham My savings and Account Servicing operations Rescission Department, the later two having the same address which were to either a PO box in Orlando or the office at sea harbor also in Orlando. So we sent one to Las Vegas, and one to the PO box with attention to My savings and to the rescission department at the location on sea harbor. Is there any other addresses that I am unaware of? We just want to make sure that all addresses are given their letter before our rescission time expires. Thank you all for the help in advance!

Just as long as you sent the letter(s) to the address(es) given in the contract, you will be fine. Make sure that you send via certified mail where you can ask for a receipt. That way you have proof that you mailed the letter(s).

The one thing to watch out for after you send your letter is the possibility of a sales person from the resort phoning you trying to persuade you to reverse your decision to rescind. They've been known to call rescinding purchasers either trying to sweeten the deal or issue threats (albeit, idle meaningless threats) saying that you'll face serious legal or financial consequences if you rescind.

Me and my husband had spent almost four thousand dollars to buy Wyndham Discovery Package in NJ.

We were unaware of there was a missing page in sales contract until we got home. The sales contract should be two pages content but Wyndham sales guy intentionally printed it with three horizontal pages. The missing page should contain rescission instruction, because the first pages referred to termination term was included continued paragraph. Thankful for "mistake" they made, otherwise we would thought we were simply made payment upfront for vacation package.

My husband called Wyndham and they said we could rescind contract by sent them email. Meanwhile I don't trust them. If I wanted to mail out certified mail, what address I would mail to?

I would really appreciation some advise

Sent them a certified letter and keep proof. While they may complete your recession based solely on the email, that may not be legally binding. A certified letter would be, and they would be required by law to complete your recession.

Like mentioned above, do both. Email is fastest, but certified mail is legally binding proof that your recession was mailed in time. It is a cheap insurance policy vs the thousands at risk.

Send both as soon as humanly possible. In NJ you have 7 calendar days from the date you signed the contract, but ASAP is always the best policy.

Also dont get hung up on what the letter needs to say. Just a simple "I am rescinding this contract." with your personal information and a copy of the signature page is sufficient. Time is of the essence.

Thanks a lot. My husband called Wyndham again for mailing address. They told him they didn't have mailing address and they only accepted email and fax. I wouldn't buy it.
I will called them after me and my husband are both off work, and mail out rescission letter no matter they accept or not. We will make a call to our credit card company too, hoping they can help us to cancel this transaction

Do you have the email address for that department by any chance? I need to follow-up on my recesion. They had two addresses in our contract. I sent a certified letter to both. Like I said in my other post I could see them having some sketchy guy setting out by the mailbox and when the postman walks up he says "you could drop those in the box or I could offer you a weekend paid vacation to ceasers palace if you just take them back undeliverable."

Thank you so much to this group and this thread in particular. You can add me to the long list of those duped by Wyndham Vacations. On May 16,2019 I foolishly listened to the sales pitch that I knew had a lot of holes and red flags. Upon review of the paperwork and the actual “deal” I did further research - found this group and just sent my cancellation letter today 5-20-19. I signed in Florida and my contract states that I have 10 calendar days to rescind. Crossing my fingers that I have no issues!

Sadly, this isn’t the first time I’ve heard of them doing this. I’ve been seeing reports of that behavior more often recently. It’s against the law to leave out pages intentionally. When you send the letter to the address the Tuggers provide, put a line in there about how the sales person left that page out of your contract. Make sure you provide a name. Wyndham may toe the line in a lot of areas, but when it comes to contracts, they don’t mess around. They care if their sales people are doing stuff like that because it opens them up to, not just a lawsuit, but also to penalties and/or fines from the state. If the sales person is required to have a real estate license to sell timeshares in that state, they can lose their license it if you can prove it was intentional. If you don’t tell them there is an issue, that sales person will continue that same tactic with other people and they may not be as smart as you and catch it.

Sending a rescission letter though email address is a ridiculous and useless way to get rid of these liars. They won't send you a confirmation of receipt or reply your email. After 3-5 days, we are solely responsible to call financial department and check status. Also as I mentioned, I miss the page of rescission instruction. I believe my contract is different from yours. Mine has only 13 paragraphs, and I miss paragraphs from 5-12. The paragraphs 9 should relates to termination of contract, but yours are in paragraph 47. Actually, most here on TUG would recommend that you not call any department at Wyndham while your rescission request is still in progress. Wyndham is under no obligation to update you on your rescission or refund status. All that Wyndham is required to do is process your rescission and issue you your refund within 45 days.

Refunds usually do not take that long but phoning the departments will likely accomplish nothing for you except for them to try to convince you to reverse your decision to rescind. Besides, the method that is usually legally binding is the certified letter and not a phone call.
