Florida Vet Assistance Assoc is legit

I am a very cautious and skeptical person and almost stopped the donation/sale process with Florida Vets Assist Assoc after reading some of the TUG posts but am glad I went through with it.

I started the process on 12/14/09 and received the final paperwork from the Title company on 2/5/10. I called and got the resort to send me a confirmation letter just to be sure that their records reflected the transfer of title as well and I received that on 2/15/10.

All in all the process was smooth and they did what they said they would on time and with no surprises. The $500 donation to Florida Vets Assist Assoc was much less expensive than the "give me money to sell it scam artists" that are out there.

I am very impressed with Fla Vets group and hopefully they do good work for the FLA Vets. I am glad I trusted them and am free of the timeshare once and for all.

Finally

As requested, I'm updating that both the title company and Westgate have completed the transactions for my timeshare. I still don't have a 'donation' receipt for the second year of maintenance in 2009 (collection agency as well), or the initial $550 paid to FVA in Oct 2008.

All and all folks, when dealing with this industry you have to, absolutely have to ensure that you are following through, documenting, and using your resources to ensure you're not scammed again and again.

Thanks Kim, finally out, yet it was a bumpy road. I'm not holding your organization responsible for 1) my initially idiocy of getting into this mess with a Timeshare, 2) the issue of the reseller hitting back at your organization.

What I was (pretty clearly) frustrated with was the lack of genuine information and communication during 2009. Every time FVA did pick up the phone, or email, our long standing transfer was 'always at the top of the list, lemme call you back'.

I just read this whole thread and am simply shocked at what I read. It is the exact same theme/story I recently read in my local paper, the St. Pete Times.

With only a slight variation of names, this sounds exactly like the Navy Veterans Association recently exposed as a fraud and currently under State of Florida and IRS investigation.

Click on the link below and read the investigative report and related articles and tell me that the Florida Veterans Assistance Association as they call themselves here isn't working like the Navy Veterans Association. Just too much coincedence. Both based in Tampa. Similiar names. Both with crude responses back to those critical of them. Both with limited ability to contact anyone. Both will full voice mail boxes, etc etc etc. Read it and you make the call. You want to believe but.....

This is one of the most despicable organizations to ever solicit in the name of charity. All under the false pretence they have ever done anything ever anywhere for our veterans. They make big claims but cant back any of it up.

We've called back several times again to speak with your settling this timeshare/repurchase from Westgate, and now we've been turned over to a collection agency for a fee well above the standard fee's that were supposedly in-flight with your group. This is also due to not actually verifying the name of the individual you're supposedly actually working with.

After unsuccessfully trying to sell/give away our timeshare here on TUG using incentives, etc., I looked for other options. I found FVAA (Florida Veterans Assistance Association). Yes, they ask for money upfront, one payble to them and one to the title company. Yes, a couple of years ago there were major delays in selling. However, I decided to go with them anyway after checking BB and other outside informational sources. I'm glad I did. The money paid was less than one year's maintenance fee and once I found their original reply in my spam folder, it took less than two months to be completely free. I am NOT taking any deduction, despite their acknowledgment letter which states "TYPICALLY, most people can write off..." {emphasis mine}. I am considering their fees as a donation (non-deductible) to their organization. The title fees were in line with other title companies charges for transfers. They are a 501(c)3 organization. All communications with them were quickly answered, once I whitelisted them. I now just have the one timeshare that I am very happy with and done with the soul-drainer timeshare.

I'm glad you are happy with your outcome, but there are other options to give timeshares away for nearly free - I hope you exhausted all your other options before paying someone to take it.

I have so little faith in this outfit let me just ask everyone this.

If they take your timeshare off your hands for "only $500" and the deed is truly and honestly transfered out of your name does that make them a legitimate company?

Or

Does the process need to include the sale of your timeshare and a monetary donation made to the Veterans has to occur as well to make them legit charity?

If they take your timeshare and your money and they sell your timeshare and pocket the money are you OK with that? Is that a legit company or a scam?

Absolutley nowehere have they proven they have done anything to help the vets or any other group, like a charity normally would.

The organization that apparently operates exactly like them, and I wrote about them a few posts earlier, The Navy Vets was just declared a "Sham Charity" by the Ohio Attorney General and indicted by an Ohio Grand Jury.

Here's an analogy- You take an item you own to a pawn shop and they give you money. Legit? A thief takes stolen merchandise to a the same pawn shop and they know it's stolen and they give him money. Are they still legit?

Stay away. Stay very far away.

I just got of the phone with FVA re:donating my timeshare and this is the deal:

Admin fee $500; she states half goes to the charity
Transfer fee is $310; she states this number is determined by the resort
Closing costs $275
She states this will be a guaranteed.

She is going to send me a tax deductible receipt for $2100 and claims this is separate from the up to $5000 tax deduction for the property itself.

Haven't done it yet, but I really want out. Want to make sure it is a legit company and charity though. Any more thoughts?

Wonder if the IRS would be interested to learn of a "charity" who promises a $2,100 tax receipt in return for a $500. "donation".. Just be sure to talk to your CPA or tax attorney before you pay any type of upfront free to sell or "donate" an unwanted timeshare..

You can claim the fair market value of your timeshare as a loss. But, if you have to pay someone to take your timeshare off your hands, the fair market value is 0 and your deduction should be 0.

If your timeshare had a resale value, you would be selling it, rather than giving it away. So how can this company state that your can take a $7,100 deduction for a TS worth 0?

That fact that she will "guarantee" it, means nothing. Do you think the IRS cares what they "guarantee"?

If you get audited, will a falsified appraisal stand up to IRS scrutiny?

Please consider giving it away to a private individual who can use it, before you spend a cent with a company like this.

Why?
-You can give it away yourself for nearly no cost.
-You can control the transfer process to make sure it is truly transferred out of your name.
-You won't have to deal with companies that may or may not be Legit.
-You can transfer it to a private individual who will be happy to have it for their own use.
-You will have the satisfaction of knowing that you ended your ownership legally and ethically.

There are two places on TUG where you can give away your TS's for free (no charge for the Ads.) There are other cheap and free sites on the internet, as well.

TUG Marketplace - the only cost is your TUG membership - $15 (List it for $1 and it will automatically go in the Bargain Basement Ads.)

Bargain Deals - Totally FREE! - just write a simple post with all the pertinent info. In your post, include the following info.:
-resort name
-unit size
-season owned
-maintenance fee
-current reservations​

To make it more attractive I would:

1) Pay 2011 maintenance fees and don't ask for reimbursement.

2) Pay for the title transfer (you can get a simple professional transfer for about $100) I've used this licensed document Prep. company and the owner is a Tugger. - Note, this is my personal recommendation, not as a representative of TUG.

3) Reserve a popular holiday week in 2011 for the new owner​

Thanks for your reply...I will try some of the things you suggested...there's no rush at this point since I've already paid 2011 maint. fees, so it won't hurt to exhaust all other options.

Curiously RichardM chose to privately email me about a company called Progressive Real Estate Company that promises "no upfront fees and only $695 at closing." It's interesting that so many of these companies are in Florida...why is that?

Does anyone have any experience with them?

There are two tax forms that always apply to this type of real property donation.. Form 8283 is filed by the donor. It requires the donor to place a fair market value on the property, and requires a certified appraisal for anything valued at over $5,000..

Up to this point, everything sounds pretty easy.. However, what most of the charities fail to tell their prospects is that another form (form 8282) has to be filed by the 501C when the donated property is sold.. On this form, the charity will enter the actual sale price when they liquidate the property.

The issues for the original donor occur because the values on form 8283 and 8282 don't match, or in most cases- are not even close!

My advice on this is very simple... If someone wants to donate an unwanted timeshare to a charity, do so without any thought to a possible tax benefit. Simply look at the terms of the donation, and compare that with all other options (including those dreaded post card companies). Try to determine your costs, and the reliability of the company itself (whether it has shown a history of actually transferring the property out of the original owners name or if it simply takes their money and often fails to perform the transfer) and then choose the most economical choice.. Do all this with the understanding that it is very likely the ownership will eventually be abandoned- with those costs falling back on the shoulders of the owner's association and being passed on to those timeshare owners who are still paying their maintenance fees..

Of course, the better option is to try to liquidate and give it away to an individual who intends to use and pay for the property. This can be done on Tug or Timeshare Forums for free, or can possibly be done through a respected brokerage who does not charge any type of upfront fee. There is no guarantee that this strategy will work, but it seems logical to at least give it a try and wait a few months to see if you can save some money- and to at least try not to dump your fees onto the shoulders of the association!

Ultimately it is up to the individual timeshare owner to make this decision.

If you feel that you've tried every other possible avenue to get rid of your timeshare and you feel that the price this charity is quoting you is worth the cost, then use it.

However, watch out for these two important points:

1) Make absolutely, positively sure that the charity actually transfers the deed out of your name. Some scams only do a Power of Attorney transfer leaving you still as the legal owner and, hence, still legally responsible for all MFs and SAs.

2) Don't waste your time or money looking for a tax deduction. Act like the tax deduction is zero. Just get the TS transferred and move on.

Steve - I see that you did post it on the TUG Bargain Board, but there were some fatal errors:

- You posted it 2 weeks before Christmas (a terrible time to sell anything) and you never bumped the post up by adding more info.

-You did say the MF was paid, but you didn't offer to pay the transfer costs.

-You didn't reserve a prime week for the new owner.

-You stated there was an unknown special assessment, but you never came back with more info. about the cost. (Deal killer.)

-You didn't say anything positive about the timeshare at all.

In this economy - that is not going to get the job done.

Fighting Back - Provide Good Service - Legitiment

I have been with the FVA Asst. Assn. for 8 years - I take pride in my job. Regardless of these comments because of one company for 250 timeshares 3-4 years ago, or the fact that Joel's middle name is Martin, we still often get the same negativity, however, public perceives different - I get people who understand the situation open mindedly- with business nothing is perfect, and those contact me. I am personally tired of the attacks on our Charity, we are a Charity since 1996 - We have transferred approximately 20,000 timeshares, and out of that, had a company return 250 to us. We did our best at handling the situation as we could. I have had return clients from that mess. I personally think timeshares are nothing but a rip off - people need to be posting about the companies that rip the public off everyday for money and never talk to them again in hopes their timeshare is sold. Giving timeshare companies money to rip you off to get nothing - we, although, some not as smooth as others, have gotten far more many people out than not, and have satisfied problems by either refunding or placing with other companies. I don't know of any thing that runs perfect in any situation - problems occur in everyday business and life. The FVA has never walked away from any problem on timeshares. We complete transfers and there are MANY satisfied donors out there. Unfortunately, little negativity goes along way, people are SO skeptical by being ripped off by listing companies, they want to ruin our standing as a long time Charity who does a good service. As a 501 C-3 Charity, registered by State of Florida, and regulated by the IRS, we are required to uphold a responsibility to the public and the Veterans. As a Registered Charity, we must participate in program services, which is what funding goes to. A recent article says we give Vets 18% of funding - we charge a fee, split in half for service of transfer, and other half to funding Vets, we could bring our percentage up to a higher percentage by charging the public more. If we were not participating in State requirements, we would not be a Charity still to this day, 15 years later.

We are in no-way a SCAM, we are a legitiment charity raising funding to, first and foremost fund veterans, and our office to continue to run and
provide an awesome service in my and many's opinion. I apologize to any one that has had a bad experience, however, it has never been our intent to take advantage of anyone, again, nothing in life is perfect, and we, at the end of the day, satisfy. If you go to the BBB, you will see we have had 9 complaints, all of which are satisfied.

We are under NO investigation by the Agricultural & Consumer Affairs Department - Please feel free to call - we did as an article states we are under investigation, we are not! It's unfortunate that a "DO GOOD" Charity has to experience slander for all the good we've done.

The negativity in the tug posts are same people over and over debating if we are legitiment since 2006, 2007, 2008. Show me a perfect operation - with no problems - love to see it - I challenge it.

We have written to them - and this subject has no bearing on the service we do. I believe in our service and I will continue to fight against "slander" against us. We will be happy to address any concerns or questions, and can provide proof of adequate funding and many REAL testimonials.

Those of you who choose to fall into this slight negativity, and not relieve yourself of your timeshare – good luck in your endeavors! We have done nothing wrong.....other than to provide thousands of people relief of their timeshare and provide our Hero's funding.

Is the best way to win us back with a lengthy accusatory post where you make every point twice?

Please note that some of the more recent posts were about positive outcomes with your charity.

You did not address the wrong and very misleading advice you have recently given one of us (see Dec 27, 2010 post). I was given the same advice a few years ago when I gave your organization $250 to take my timeshare. I even showed a manger at FVA the IRS rules and explained how wrong it was.

I lost $250 to your organization. I have never received a donation letter, my timeshare was never transferred and I could never get anyone to address my case.

I am all for forgiving your organization of past mistakes. If they have changed there ways an made up for past errors when possible.

Are you still advising people who use your organization to get rid of TS that they can deduct thousands of dollars on there taxes because of there "donation" when in fact they can deduct nothing? Perhaps the part of your fees that go towards charity can be deducted, but not the thousands of dollars you have advised in the past.

What about people like me who have considered using your organization again, even though they lost $250 last time, never received a receipt and have not been offered any compensation?

With all due respect, in my opinion these are two uniquely poor options to consider or pursue; both would cost you money up front and neither guarantees you a prompt, lawful, duly recorded transfer of ownership.

I'd also point out that the "legal action" entity you've listed (second link above) is U.S. based, whereas your particular timeshare is in Canada. Different countries, different laws, different legal jurisdictions. I don't know, but I doubt that attorney Sussman belongs to any Canadian bars (meaning bar associations, not drinking establishments ;)), so how could he even represent you at all, fee and / or retainer notwithstanding? :shrug:

I disagree that the timeshare industry is "in for a colossal bust", but that's another (...and for now irrelevant) topic or conversation. That issue aside, for now we're just trying to help you avoid any hasty, expensive and likely unproductive actions while maybe a bit antsy and a little desperate to get rid of a unwanted timeshare.

Again: Your best option for a legal and inexpensive transfer is to do it yourself:

Most "charities" that accept timeshares these days are actually companies that have been set up to make a nice profit off the transaction fees - not true charities. They will usually charge you hundreds or thousands of dollars to "take your timeshare off your hands" - they won't take it for free, because they are making a profit off the fees.

The worst of these companies are just scammers:

-Some collect the upfront fees, but never actually take the timeshare out of your name, so you lose the money, but still own the timeshare.

-Some promise a high (fraudulent) tax write-off that can get you in trouble with the IRS if you are audited.

-Some are "Viking Ship LLC's" that take the deed off your hands, but then register it to a LLC, bankrupt the LLC, and abandon the deed - making it difficult for your resort and the remaining owners to recover the deed.

This is what you have to come to grips with: If you have to PAY to get rid of your timeshare, it has NO resale value, and throwing more money at it won't change that. So cut your losses, and get rid of it as cheaply as possible - by doing it yourself.

Please consider giving your timeshare away to a private individual who would like to own it, before you spend a cent with a company like this.

Why?
-You can give it away yourself for nearly no cost.
-You can control the transfer process to make sure it is truly transferred out of your name.
-You won't have to deal with companies that may or may not be Legit.
-You can transfer it to a private individual who will be happy to have it for their own use.
-You will have the satisfaction of knowing that you ended your ownership legally and ethically.

There are TWO places on TUG where you can give away your TS's for free (no charge for the Ads.) THEY ARE COMPLETELY DIFFERENT - SO YOU SHOULD POST IN BOTH AREAS. There are other cheap and free sites on the internet, as well.

TUG Marketplace - the only cost is your TUG membership - $15 (List it for $1 and it will automatically go in the Bargain Basement Ads.)

Bargain Deals - Totally FREE! - just write a simple post with all the pertinent info. In your post, include the following info.:
-resort name
-unit size
-season owned
-maintenance fee
-current reservations​

To make it more attractive I would:

1) Pay the 2013/2014 maintenance fees and don't ask for reimbursement.

2) Pay for the title transfer (you can get a simple title transfer with no escrow or title search for about $100.) Many Tuggers (including me) have been using Legal Timeshare Transfers, a no frills document preparation company, and they are receiving good reviews on TUG.:

3) Reserve a popular holiday week in 2013/14 for the new owner

4) Instead of paying a fee to a rescue company - consider offering a cash incentive to the new owner.
