Ebay Listings - Are these believable and do they pass ROFR?

First time poster, long-time reader. :)

I have to ask, are such listings believable, and do they ever pass ROFR? Here's the latest one I saw on Ebay: http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&Item=370128091036&Category=15897

Hilton on International Drive, Orlando - Annual 9,600 pts, starting bid $1.00.

Few things that surprise me. #1, the low starting bid. #2, no reserve price.

Am I missing anything re: the seller, or the possibility of this one even closing? If I was selling, why wouldn't I put a reserve price to help ensure to the buyer that this will pass ROFR....

I know this is marketing at its best, putting crappy low price to get people interested, but just seems little reckless to the eventual buyer.

Comments welcome!

NOTE: In re-reading the listing, this might be the 'tip off as to why it's too good to be true: (Please note that this huge level of points was achieved by combining TWO 1-bedroom ownerships into one large points ownership)

So if they are selling two 4800 platinum 1 bd weeks it should be worth about $12,000 or more. ( since each one should sell for mare than $6000)

Is this likely to pass ROFR. I'd really doubt it!

This is a relisting of an auction which I had won before for a price of USD 12100 (ebay 370116822302). I was expecting to buy 9600 points in one 2bd unit (premier) as it was stated in the auction.

When I asked the closing company for the deed I found out that it was actually two 1 bedroom units at 4800 points each. So I chose to pass on this one.

Just wanted to give you an idea of what the final price might look like. I still think that 12100 for two 1 bedroom units is a very good price though. But I was looking for something different.

Does it depress other HGVC prices that's what I would be concerned with? Furthermore, does it devalue his existing inventory?

I would expect a reserve and a starting bid price that makes it sounds more believable.

I'm guessing the seller doesn't care, particularly if he finds a seller that forces HGVC to execute ROFR.

Closing

Appears to have closed at $10,661, or $1.11 per point.

Total maint fees are forecasted to be $1,147 (includes taxes).

Not a bad deal unless the MF offsets it over time (being that they would own two 1BR units).

It will almost definitely be bought back. I had a 4800 point unit bought bach last week at $7,800.

Unless fraudulent Right of First Refusal documents were submitted to Hilton (which would put a cloud on the title), it will be bought back. If fraudulent Right of First Refusal documents were submitted, it will be forwarded to Hilton's legal department.

Gold versus Platinum seasons makes a difference. The Platinum 1 BR at 4800 points was bought back. The Gold 2 BR at 5000 points was not.

The MFs on the 2 BR will be significantly higher then the 1 BR for roughly the same amount of points. Making the Platinum week a better purchase long term.

Platinum weeks are being taken on ROFR more often than Gold weeks are. See this post by Seth
