Hi All,

Is there a minimum charge on the 3$ per point transfer fee? I seem to think that it is or was 3000$ which would make it more difficult for those trying to sell 1750 points or less.

Are those fees in the actual deeds or could they decide to make it 4$ (or minimum 5k) for example just because?

$750 per beneficial interest or $3 per point with $3000 minimum.

Not sure where $1750 comes from as 1000 points would be $3000. Not many point contacts out there for less than 1000.

They can change the fee just because. That’s what they did when it went to $3.

I’m. Wondering here what the legal basis is for that as clearly they must have something in the deed, or do they have to give notice of current fees and or increases.

I can see legitimacy in an rofr fee, but a per unit transfer fee seems rather questionable from a legal standpoint as this certainly affects the ability of someone to freely dispose of owned property and how can they justify charging 1/8th of the retail price of a new sale before any discounts (more like a sixth based on 2250 point purchase today.

This is effectively a sales tax assessed by Marriott.

It is not "owned property." It is an interest in a Club, based on points, held in a trust. A trust point owner in the Club does not own any deeded property. In fact, my opinion is the Club itself violates the governing documents of the deeds in the Club trust, but I digress.

In other words, MVC does whatever it wants, and in the words of so many posters here, you can either sue or deal with it. But to the extent the Club is legal, they can make any rules they want for those who want to be, or are, part of their Club.

I believe the description posted here somewhere is that you can theoretically use your points without paying the junk fee. However,if you want to join the Club, then the activation fee applies.

Its in the exchange procedures along with a clause that says they can alter as needed.

They get round the issue raised by davidvel by enabling you to use the Club points in Abound without the "initiation" fee, but with a restricted reservation window. If you want the added on, "discretionary" perks of longer reservation window etc etc, you join the programme via the initiation fee, then they work just the same as the ones bought direct.
