*** New Thread: KBV Vote for Chapter 11 Bankruptcy

FYI….We had a reservation for two weeks in March of 2026. We called to inquire about status and yesterday received a return call from Wyndham informing us that our reservation was cancelled due to the closing of resort.
 
We received a call from KBV today to confirm that our reservation was scheduled for August 2026 is CANCELLED. She said there will be no one working at the resort after 12/31/2025. She also said she had no other information. I asked if we would be receiving a notice from the board and she didn't think so. She did give me a email and she said she was told to give it if people questions. kbvaoao@gmail.com

So are we to assume we won’t pay any dues/maintenance fees in 2026 given we can’t make a reservation? Would be nice for the board to actually update owners on wtf is happening.
 
The current BOD has never been reliable in the past, and under the current circumstances, I suspect that they will only get worse.

There could be some costs that have to be paid during the wind-down, and if there are not sufficient funds in reserve, owenrs of record will be responsbile for those. They would be modest relative to our "regular" annual fee.
 
(I also would not be surprised if it takes a little time for them to figure out what the costs are going to be, since not many people have experience running resorts that are in wind-down.)
 
I emailed the address given above and asked about maintenance fees next year. They said they could not answer that question at this time. They did confirm they decided to temporarily shut down the resort starting January 2026 due to safety issues. They also directed me back to the website with the questions and answers.
 
We are also being affected by Wyndham's bankruptcy actions on the 14 other Wyndham resorts that are closing but KBV is not even mentioned. Why? What's different? At the very least, KBV should at least be mentioned with a footnote as to what is going on.

Also, why should their be maintenance fees for 2026 when the reserves should be enough? All it takes is a vote by the possibly conflicted BOD. And no one has contacted us on our questions to the BOD and the Wyndham rep in charge. This is at the least bad faith and the most fiduciary responsibility breach. I asked what was done to the special assessment monies we paid but am waiting an answer about that too.

Shakespeare said that " Something is rotten in the state of Denmark " but I like two know what's happening in the state of KBV?

The Interval Owners Association is responsible for maintaining the interior of the apartments in the Association. The costs are funded by your annual maintenance fees. The Association did not sell you your interval. Until you transfer the title to a new owner you are responsible for payment of maintenance fees. The Association is not aware of anyone interested in purchasing Kauai Beach Villas Intervals. You can give it away if you find someone who will accept responsibility for the maintenance fee. You have a deed for the interval. The only way to transfer the interval to another person is to execute a deed of transfer or a quit claim deed. The deed needs to be registered with Kauai County and transfer fees paid.

At KBV? Do you have any documentation for this?
 
I don’t know if anything substantive; they voted to close reservations beginning Jan 1 2026. Seem to have quite a bit of money, something like $15 mil in reserves, and 1.5 mil for operating budget. I didn’t stay for discussion.
Somewhere along the way I must have requested this so I received the KBV IOA audit report today as of 12/31/24. It seems they had about $6 million in the operating fund and $13.7 million in the replacement fund. This was in an email from Liane.Henderson"AT"travelandleisure.com. Just a point of information for you all.

Posts #67, #68 & #81on this thread. Correct me if I'm not reading these posts accurately.
 
As the author of #67, I said no such thing.

The vote authorized the HOA to take back Units or Intervals. It did not require they do so, and I haven't seen anyone report evidence that they've taken back anything. If things have changed hands, the deeds will have been recorded at Kauai County. I am not currently motivated to search them, but if someone wants to perhaps they will share what they find.

On October 7th, Wiss Janny Elstner (WJE) provided the Kauai Beach Villas AOAO and IOA Boards of Directors an update on the condition of the association's buildings. Upon being made aware of WJE's additional findings of potentially unsafe conditions resulting from building deterioration, and upon WJE's recommendation, the IOA Board of Directors determined that for the safety of all timeshare owners and guests that all timeshare unit occupancy will be discontinued as of January 1, 2026.

If you are a deeded weeks owner currently holding an existing reservation in 2026, you will be contacted by the PAHIO Owner Services team for further details concerning the cancellation of your reservation(s). The PAHIO Owner Services team may also be contacted directly at (866) 523-8477. If you are a Club Wyndham points owner, you will be contacted by Wyndham's Owner Services team to discuss options which may include cancellation, rebooking to another CWP-affiliated resort or other Kauai/Hawaii-based options. Wyndham's Owner Services team may also be contacted directly at (877) 883-3640. If you have banked your week with RCI, all points banked with RCI need to be used prior to the account becoming inactive with the bankruptcy and sale of the property. The RCI Owner Services team may also be contacted directly at (800) 338-7777.

For all remaining guests and owners arriving to Kauai Beach Villas this year, please be informed that, upon arrival to the resort, you will be provided safety information including but not limited to the necessary prohibition of accessing all 2nd/3rd floor unit lanais/balconies due to safety concerns. Additionally, Buildings G and H remain closed for ongoing structural repairs.

It has just taken this long for subsequent events to play out.
 
Schreff - thanks for posting your letter. We haven't received ours yet. It includes some interesting details that have not been spelled out in the past. I hadn't thought about all RCI deposits from KBV being cancelled, but I guess it is inevitable. I'm glad that I only own deeded weeks at KBV, because I'm so ready to wash my hands of it! (n)

Your welcome and I agree 100%. We are also involved in the big 14 Wyndham bankruptcy both in owning 4 weeks of legacy properties involved and the elimination of all resorts close to our home which we visited frequently-Skyline Towers, Shawnee, and Bentley Brook. After paying mucho bucks to reach VIP Platinum it looks like that all goes down the Wyndham drain. Not happy.

I agree it is illogical that KBV would be treated separately from any other 14 Wyndham properties that are being removed from the Club Wyndham portfolio. The process they are using (bankruptcy) is the same, TNL/Wyndham's involvement as the manager/controlling interest owner is the same. Even the same law firm (K&L Gates).

So why would KBV be treated any differently? Some saber rattling may need to occur to change the direction.
