Must sign request to rescind notice?

Sorry, couldn’t find a definitive answer on this. My wife and I signed up for an MVC contract yesterday but after much research and reflection decided to opt out. The contract says we can email the cancellation request or mail it - I did both, the letter certified. I’ve read here where both of us should sign but the contract doesn’t say that and we didn’t, though I did list the customer number and our names and my phone number. Is signing it a must? I ask because the contract didn’t say to and if they accept email requests I didn’t think it was required. Thoughts?
 
Out of an abundance of caution, I suggest you resend it signed. You’re on a clock and you don’t want to give them excuses to not accept your rescission.

Thanks, yes I’m sure that’s the safest route. We just signed yesterday and I have 10 days but I’ll send it again in a couple of days with our signatures. Still traveling for another week so thought I’d ask.
 
I would resend with signatures. The piece of mind is worth the minimal cost of another certified letter.
 
If you look at the earlier posted 'suggested rescission' templates, I always listed. . . . .
'Signed. . .________________________ husband.
. . ._________________________ Wife.
Nobody has EVER come back and said ' I/We REALLY didn't need to sign the rescission letter, so we sent back the money.

Where are you? We canceled no problem dropping off a letter at the gallery. No asking for sakes rep . Some 16 year old kid signed it was recieved
 

The Abound is a timeshare plan existing and offered in Florida, and is bound by Florida laws. To rescind Florida statutes only reference a notice, and I can find nothing that requires any formal signature of the buyers. https://www.flsenate.gov/Laws/Statutes/2023/Chapter721/All
Interesting! It clearly doesn’t require it. I wonder if they’ll acknowledge receipt of my emailed notice to cancel in the next few days. If not I’ll resend a signed certified letter to be safe, thanks for checking 😊.

I think some companies stated that all buyers had to sign, which started the advice. With the thousands at risk, I wouldn't hesitate to do so, if not in an abundance of caution. Generally they do not confirm prior to 10 days, but .... I would also send via usps priority mail. It is worth the minimal cost.

Some random person is going to know you bought and where and the info identifying you with the timeshare and decide to send a recission notice to the TS? Really? Why? How? That doesn't make a lot of sense.

Even if so, what is to stop them from signing your name at the end? The TS doesn't have your signature on file, or a forensic examiner.
 
Well, we’re at our next hotel so I typed up another letter to MVC exercising our right to cancel with our signatures. I re-sent my previous email to them with a photo of our signed letter attached and will mail that letter, again via certified mail, to them later this morning. This should cover all the bases - I’ll follow up here once this is resolved. Feel kind of silly letting them talk us into this in the first place but oh well, we all make mistakes!
 
so very happy you found TUG in time to rescind and buy resale!

in 20 years you can still be here on TUG helping the next generation of owners do the exact same thing....after taking dozens of wonderful vacations and saving money doing it!

Don't beat yourself up, we rescinded a few years ago (we have a deeded week and 2500 points) and we briefly went up to the executive level. Once we had time to really think about it, we rescinded. We did the email and the certified letter, and it all worked out. In the moment, it all sounds so good to get to executive....it is very tempting, and they give you a lot of incentives. It doesn't make sense for how we travel currently. Yesterday we did a virtual update, and they try to put some "fear" in us that we are going to miss out on something if we don't act now. They were even very surprised that we didn't want another encore package (we have done 3 and really got our money's worth, but don't see a need to do another one right now).
 
Well, Marriott refunded my deposit today so all good! Thanks for the advice here, I’ll look into resale now 😊.
Hate to ask.... What timeshare plan(s) are you now looking at?

There are just too many complicated games to play (a fellow TUG's line, please claim it....)

I feel timeshares... ok... only resale can be undervalued...

Hope you figure out what works for you. :)
