HGVC Resale limited rights

That is a good deal. I thought it was only at that property or in bHC but all bHC and HGVC is a pretty good deal.

It’s one of a couple reasons I bought an EOY bHC. Allows for some speculative bookings and also makes it easier to justify some shorter stays.
 
Little update: Sent an email to the cancellation office asking if I needed to mail the cancellation letter or if I can drop it off in person (I live 30 min away). Was told the email and phone call would suffice. So I’ve cancelled the contract and am on the hunt for resale. Thanks everyone who helped me dodge this $17K mistake!

Yes, that is a nice. That is one of the reasons that I wanted EP....speculative bookings and enough points to do it.

In your contract, there should be a cancellation page, normally the last page. If so, I would sign it and send it certified mail. Someone there could say that they didn't receive a call and you would be stuck. HGV is very good a honoring the cancellations but you need to follow the directions in your contract to protect yourself.

Now, on the resale topic. This is a good time to be on the look out for a resale. MFs are coming due and people will want to sell theirs before they have to pay them. Also, with the weak pound, it is a good time to look at Scotland.

And, I'd also put a printed out copy of the email from HGVC and your email rescission and note in your letter, "I have also included my prior rescission email that was sent pursuant to HGVC instructions." That way, if you're now past the rescission period, you've sent proof that HGVC said you can email. HGVC should honor the email per HGVC saying it's OK. They're a stand-up company. But, technically, I don't know if an email suffices under Hawaii timeshare law (see below). Everyone on the contract should and sign the letter you send. It's worth a bit a bit of hassle to just button it up now, esp. if you're still within rescission (7 days?)--be sure to get proof of mailing and receipt. It's the date MAILED that needs to be within the rescission window.
How to Cancel a Timeshare Contract in Hawaii
You can cancel a Hawaii timeshare contract by:
  • personally delivering a notice of the cancellation at the address specified in the contract, or
  • mailing the notice to the address specified in the purchase contract. (Haw. Rev. Stat. § 514E-8). If you mail a cancellation notice, you should send it by some method you can track.
The notice is considered given on the date that you hand-deliver or mail the cancellation. (Haw. Rev. Stat. § 514E-8).
