Opinion Needed! [Offer on free timeshare from Mark Nayman]

Hi Everyone,
I am currently trying to get rid of a timeshare in Florida and have posted it here on the classifieds. I have been contacted by an individual who wants me to send him a copy of my deed so he can start the proceed of transfer. He claims that he has done this on his own in the past and that he has a real estate license. What do you think? I would be happy in getting this thing off my hands. I am not trying to make any money, just be rid of the maintenance fees.

We need a lot more info.:

What terms is he offering you?

What is this person's name?
 
Get all their personal information and let them have at it. Tell them you need a timeline, though. Last thing you need is to connect with a flake who doesn't do anything after you send your deed.

WOW! Thanks for all of your responses!

He is willing to pay all closing but wants to do this NOW! He says that he is local and will do everything in person at the "courthouse" and at the resort.

Before you send him a copy of the deed I would have a purchase agreement signed by him and you, with both your names and addresses, stating the resort name, the week and room on the current deed, when his ownership will start and when he will first be responsible for the maintenance fees and the sale price. In this case I would put $1 for the sale price.

Once you have this agreement with him the next step will be to send him a copy of your deed so he can draw up a new deed with him as buyer and you as seller.

To draw up a new deed, anyone who does it needs the old deed to get the info correct.

Denise will help you figure out if this person is legit and if he is, these are the steps you'll probably want to take.

OK. He has no tug I.D. He just stated again that he just needs the condo. info. so he can start the paperwork.

I just sent him an email requesting either his real-estate license and/or a purchase agreement so we will see what the response will be. Thnx

How can he provide a purchase agreement if he doesn't know what it is he is buying? You are the seller so you should be providing the purchase agreement where he would then fill out all his info. If you want him to do the work for you then it seems harmless but I would be skeptical.

Yes, very good point. In my request for a purchase agreement, I gave him the option of starting one or that I could.
 
It seems too bizarre to be a scam, but I don't think like a seasoned criminal.

Logic says that if he transfers the deed, you won't be billed for taxes ever again. Problem is, that does nothing for transferring your name at the resort. Therefore, the resort will charge a transfer fee to recognize the new owner.

Worst case scenario - the deed transfers but your resort doesn't. Then, you have to pay MFs until the end of time? I don't see a benefit for a scammer, but I don't think like them. I think in your situation, I'd offer to pay a closing company to deal with the entire transfer.

Not all resorts have a transfer fee.

Once he records the new need he can present the recorded deed to the resort and get the transfer there done. You can also notify your resort that there is going to be a new owner for your unit.

No need to pay an extra $150 to give this away if he's willing to write up the new deed and get it recorded.

I would get purchase agreement or sales contract or whatever you want to call it and proceed.

Since the seller would remain on the hook for maintenance fees if the transfer was never completed, either the seller should do it or pay the neutral party the $150
 
I believe I am dealing with the same person, exactly the same situation and approach. Do you have any updates? I am wondering if i should proceed?
 
Unless he has moved on to another property, that might be a Red Flag

Have either of you asked for a copy of his real estate license? That seems to be where he stopped communication with the OP.
