What is this Class Action Suit?

I just received a message from another owner (stranger to me) about a class action suit I know nothing about. Any information out there?
 
The is someone who has been pestering TUG members regarding this issue. Can you please forward their email to me?
 
I suspect that this is from Robin Miller who has worked long and hard and gone to considerable expense to get the list of WM owners from Wyndam. Despite the fact that WM ownership roster is supposed to be available to any member for non commercial purposes Wyndam has tried to block this and this gentleman went to court and got the list- so he did not get it from TUG. There is a growing concern about what Wyndam is doing to WM-the best thing to do is to go to:

When discussing WM it is very important to realize that it is a very different model than Wyndam Resorts. Worldmark the club owns all resorts- Wyndam is the developer and the club manager.

In a recent class action suit a proposed settlement has been reached but contains many clauses that will materially affect your rights as a WM owner. Mr. Miller is encouraging people to opt out of the settlement to preserve your future rights. Basically if you do not opt out you will be bound by all the terms of the settlement which includes material changes to credit values and many other rights you currently have as a WM owner and ignores the original governing documents.

But time is running out. Opt out letters MUST be postmarked no later than July 8.
 
:cheer: :cheer: :cheer: :cheer: :cheer: :cheer: :cheer: YES!!!! It is Mr. Miller. The court must have upheld the decision!!! Finally owners will be able to have real communication instead of that censored stuff that WYN allows.

The guy that was pestering was that man that was saying he was a lawyer type that was working on an objection to the settlement. That's a different person.

The email that all WM owners have just gotten is from Robin Miller, an ordinary WM owner, who has won a court battle (which was filed by Wyndham when Mr Miller requested the owner contact list), all the way to the California Appellate Court, to get the contact list of all WM owners, for the purpose of communicating with fellow owners, as the WM Board is being controlled by Wyndham for Wyndham objectives (at the risk of conflict of interest). This is a battle that many other timeshare brand owners have fought or are fighting, and which WM owners have won, in the legal system. :clap:

The guy who has been contacting TUG members is Steve Willett, a lawyer.

There are 2 deriviative cases from the Wixon case, one settled last year, against the WM Board of Directors, and the currently active one, against Wyndham.

Any WM owner should have received a notice from the Court regarding your options in this case:
1. You could object, in which case if the case is approved by the Court, you will lose future rights to participate in any lawsuit that any other WM owners will bring forth, or
2. You could opt out, preserving future rights in future lawsuits.
3. If you do none of the above, you are deemed to agree to the proposed settlement (per Wyndham).

If you object, you must be present, in person or by attorney, at the Court hearing on August 5 in San Francisco. Your objection letter must be received by the 3 parties (Court, Plaintiffs' attorney, Defendant's attorney) by July 8. The addresses are on WMOwners.com (WMO):

If you opt out, your opt-out letter must be postmarked by July 8, and required to be sent just to the Plaintiffs' attorney. But it is advisable that it be sent to the Court in addition, just in case the Plaintiffs' attorney does not receive it for some reason. :doh:

Please opt out ASAP Deadline is July 8

Please opt out by July 8. I personally know Mr. Miller and consider him to be a friend. We met through worldmark. Mr. Miller is a Passionate advocate for owners and has worked hard on our behalf. He has nothing to gain personally from this effort other than the protection of the Club we all own and love.
