Westin Riverfront Mountain Villas onsite presentation and purchase - resale will be grandfathered

We were onsite last week for the holiday and attended a presentation. This resort is still selling VSN SO/Flex. Ended up buying 37,000 Westin Flex with the caveat that they would grandfather in a previously purchased on resale 2BR Bay Vista WSJ Platinum Plus week worth 10K club points. With this, that contract would be in network and would bump us to Chairman.

Question - we never received any paperwork confirming this grandfathering commitment, but we do have an email from the sales manager who actually responded after the deal closed! Should I be concerned that there wasn't any paperwork presented during closing? Rescind period ends in 3 days.
 
When did you buy the St. John? If it was before August of 2022 (???), you should already be in Abound. How much did you pay?
 
The resale week at WSJ is in Bay Vista which is not a mandatory resort, so no the resale purchase does not automatically get enrolled into the network.
 
Does the sales manager email document the deal including enrollment of resale? I am also curious if the enrollment into ”the network” is just staroptions or will it also convert to marriott destination points?
 
I have an email from the sales manager committing to this, but the formal document is on its way to me via email...although he said it would arrive Monday (yesterday) and hasn't. I am just worried that something will fall through and the rescind period ends in 3 days from today. Should I believe the sales manager? It's a lot of money to lose if we don't get this grandfather commitment which will also take us to Chairman level. Once you in are in the VSN network and have access to the staroption value (for this, 176,100), you can then put into abound to do the club points exchange.
 
I suppose you could rescind if it doesn't get to you on time. You will reach out to them and let them know you were just covering your bases. You are interested in signing it again as long as the agreement is included in the contract. I presume they will be more than happy to sell it again if they were planning on including the grandfathering agreement.
The problem you will run into if it is not included in the contract is there is usually a clause in the contract that says everything and every agreement is in this contract.

I think you have your answer. Rescind ASAP. Your gut is telling you to rescind. Follow your gut. You have the right to review legal documents and they are purposely dragging their feet. If you still want to purchase you can always contact them and they can do it by mail.
 
I have found Vistana to be honest as far as doing what they promise for a sale. Retroing a unit is part of their business as usual. I would not expect them to try to swindle me. Can they email you a scan of the paperwork?

I purchased 37,000 Westin Flex back in April while at Nanea. Part of that deal was to have them retro 81,000 Westin Flex that I had just purchased resale as well as a resale 81,000 WKV(purchased in 2023) so that all would be able to be converted to Club Points and used in Abound. When completed it would get us to Presidential status. I only had the email from the sales rep and the sales contract did not include any language related to the requal. It took some time but everything worked out. The sales rep did some follow-up to ensure the retro took place. I did have to complete some additional paperwork. Deal done on Apr 11 and everything in my Vistana account was there and available in Abound on Aug 2nd.
 
Ok, the last few responses make me feel better. The VSN folks do seem much more honest than the MVC folks. Yes, the onsite sales manager has been emailing me back and confirming he's escalating. Got another email today that the Sales Leader of that locaiton is also on it. Have his name too.
 
Covering your bases does not necessarily mean the VSN will intentionally try to renege on the agreement. If that agreement doesn't make it into that contract, I am not sure how you will be able to fix it even if it was an error on their part. They will gladly sell you the same deal if you rescind. So just watch your calendar to make sure you back out when you legally can.

This may be smoke and mirrors to stall past the rescission timeframe. If it’s not legally spelled out what you want, RESCIND.
 
I worked with sales people both at Vistana and Marriott (via TUG referrals), and in both cases, the retro went through even though they were not written in the contracts (There were separate forms the sales person submitted to different departments to enroll resale weeks)
 
This isn’t anything new for VIstana. They do requalifications all the time. This should have been in an addendum to your sales contract. I would question why it wasn’t.
 
What @WorldT said. Rescind and force them to put it in writing. They will do what it takes to close. And If they don't, then you would have avoided an expensive mistake.

Cover yourself. There is no reason not to.
