Westin (Flex Collection, LLC) Rescission Address, Sample Letters and Calculating the 10 Days

A few hours on TUG has convinced me buying direct - - - Kierland Flex Collection (44K) - - - does not provide me and my wife with the best return on our investment. I will have to convince my wife of the same and we can hopefully agree to back out of the transaction.

The State of Arizona Rescission Rights disclosue speaks to the 10 days but does not define the delivery address. Per the Purchase/Sale Agreement, the seller is:
Flex Collection, LLC
9002 San Marco Court
Orlando Fl 32819
Would anyone be able to confirm if that is the correct address to send my rescission letter?

Is there an authoratative rescission letter? Or can anyone provide a sample?

How is the 10 days calculated?
We signed our agreement on Tues 6/21/2022. I assume the letter needs to be mailed on, or before Thurs 6/30.

Wonderful information on this site, and a real eye-opener. I also want to be clear, I feel like the sales team at Kierland gave a thorough explanation of the "benefits" of the investment. I don't feel they were 'shady' or deceitful. There job is to sell and they are experts at positioning the positive. I had to come to TUG to see the underbelly.

This is a copy of my recission letter that seemed to do the trick though ours was Sheraton Flex. I will note we did not receive a confirmation that it was cancelled however an email later on confirmed it.


To whom it concerns:

Regarding contract [contract#] for the purchase of Vacation Ownership Interest in Flex Vacations Ownership Plan; we are exercising our legal right to cancel this contract.

Please do not make any additional charges to any of our accounts.

Please confirm our legal rescission in writing.

Correct address is:

Attn: New Owner Administration Department
9002 San Marco Court
Orlando FL 32819

10 days are calculated as follows:
".... by midnight on the tenth (10th) calendar day, or any longer period of time allowed in this agreement, following the day the owner/Purchaser executed the Purchase Agreement..."
The letter went out today, but I had until July 1st.

Did you have to contact them via email to get a confirmation that the recission was confirmed?

Kind of... They emailed me to start setting up my online account and I replied back that we rescinded and asked them to confirm they closed our account. I got an emailed response that the account was indeed closed and no further action was needed.

Generally you won't hear from them. They may send a letter, but usually not. Their only obligation is to cancel the contract and refund your down payment. Once your down payment is refunded, you are good.

Can I ask how long it took to see a credit of the down payment?
Letter was sent within rescission period, and I'm waiting to see credit on my credit card.
My billing period closes shortly, and I'd prefer not to have this open.
I guess an option is to 'contest' the charge, but thinking that may cause some headaches.

You could contest the charge to prevent the need to pay the payment and possible interest, but usually payment isn't due until 20 days or more after the statement date and as long as they refund prior to that date, you should be okay. You may want to contact your credit card company and ask them what to do. How long ago did you send your rescission letter?

I sent letter on June 29, received/signed for on July 2.

Billing period has closed but payment is not due for a few days.

I’ll be calling credit card company later today.

Appreciate your replies.
