Welk Resort in Escondido, CA

Just wanted to share my experience with Welk Resort in Escondido, CA. We were approached few weeks ago about a presentation and the gifts that comes along with it just for attending a 120 minute presentation, so my wife and I said sure. We talked about the presentation and decided that we will not buy timeshare once we get there.

So the presentation day came and our appointment was for 11 am. Long story short we got suckered into buying 120,000 points for $19,999 and they even gave us a $2,000 discount for being military so price was down to $18,000. The 120 minute presentation lasted 5 hours with growling stomachs although they did have snacks but it wasn't lunch. Anyway, we thought we got a pretty good deal because they lowered the price so we went for it.

The last stop was with a guy named Steve to sign all the paperwork. There was two different stacks of paper on the side of his desk about California Law and stuff, aside from the papers that we need to sign. After all papers were signed he asked if I wanted a hard copy of the stacks of papers on the side or if I want a thumbdrive that has digital copy, I opted for the hard copy. He put all the signed papers in the Owner's Manual binder and was showing us the way out when I glanced at his desk and the stack of paper we're still there so I asked if those were ours and he said yes and that he almost forgot.

When we got home that day, we didn't even look at the contract at all. After a day, my wife and I spoke about the timeshare if it's something we need and/or if we can even afford it with the budget that we have. We both felt we were pressured into buying Welk Resort timeshare program so I started researching online and I reviewed the contract. Those stack of paper saved us $18,000 as it contains the form and instructions on how to rescind the timeshare contract. If I had opted for the thumdrive and not the hard copy, I would have not seen that form.

Also I found out that Welk opened a credit card with Bank of America in behalf of my wife. Though we did sign the application, I told our sales guy that we do not want to open a credit card because we used our own credit card to pay for the downpayment.

We signed the contract 09/25 and by 09/27 I sent them a fax of my rescission letter and a sent postmarked certified mail as well on the same day. I have saved all my receipts. Today 09/28, Steve called to confirm our cancellation and tried to get me not to cancel. So I asked Steve if they are going to cancel the credit card they opened and he said that they can't, that we would have to wait for the card to come in and cancel it. I'm not sure if this is true that they can't cancel the credit card. Any advise on this? I'm sure I can cancel the card once it comes in but it will definitely affect my wfie's credit by doing so.

Steve asked me to return the Owner's Manual so they may start the cancellation process. Is this true that they need the manaul back before they can process the cancellation?

glad you were able to rescind in time and save a fortune on something you could buy for pennies on the resale market!

when you get the mailer from the card, you can likely call then and cancel it immediately.

By law, they have to process the rescission with nothing more than receipt of your rescission letter. However, they can withhold funds for any materials not returned, so you should return all materials, before you find out that they deem that owner's manual as a $500 value.

I intend to return all materials. It may cost me a bit to send this 15 lbs owner's manual binder back but at least we saved ourselves a timeshare headache.

Wouldn't that affect my wife's credit?

Each time a credit check is done against a person's credit history, it will drop the person's credit ratings by a few points. It is negligible and should recover after a year. That is why you do not want to apply for a new card frequently.. When the person then cancels the card, it has little to no effect on the credit history, and sometimes even improves it.

Send it "media mail," (book rate) - very low cost. Take pictures of everything to document that it was mailed and get a receipt.

Wouldn't that affect my wife's credit?

If it does - it will be minor. That would be my last concern - you don't want to have a credit card open that the resort can charge on.

if any credit hit has happened, as mentioned above its already taken effect.

cancelling the card shouldnt have any additional impact TBH. (assuming you dont have a bunch of other cards youve applied for recently etc)

Depending entirely on your current credit situation, keeping the card (without charging to it significantly) could actually enhance your score by decreasing your credit usage %. I have a hunch that Usage % isn't an issue for you, though, and if that's true, even the credit application ding is unlikely to be big enoughto materially hurt your score.

CoyRams, congratulations on rescinding your purchase in time.

I don't think anyone has mentioned this yet, but if the two of you think time sharing is a good way to vacation, which people on TUG certainly do, then do more research on the various products out there and consider how you would like to vacation now and in the future, and then buy on the resale market. You will save a lot of money.

Lawrence Welk Resorts need to be blacklisted because of he high pressure, deceptive sales tactics.
I am not sure if the credit card concern.
We were suckered in last year but cancelled next AM and never received a credit card through LW.
