Hello,

I apologize if this is the 1000th time someone asks for help for the same thing :/

I have been reading through the forums and have been learning quite a bit now.

My question is, how do i get out of my contract?

I gave in, in one of the meetings (4hrs) and was initially sold on what would seem like a great deal.
I gave a deposit, signed papers, shook hands etc... and was on my way.

Once i got home, i happily started reviewing each document and researching online for what i had gotten myself into.
I was pretty much immediately ashamed and scared of what i signed up for, and now i want out.

I know my rescind period is long gone, from what i read here, and at this point the 2500 deposit i put down is what im willing to lose for my mistake.

I contacted accounting services at Vida Vacations, and we are 12 emails in, with them trying to find a solution to have me pay. Basically i told them i cant.

They are stating that they would rather avoid any forfeiture of funds (after looking this up, im even more nervous now).

I really do not know what to do at this point. If someone can point me into the right direction i would be relieved.

I appreciate the help!

1) DO NOT pay anyone to "help you get out of your contract"

2) By accounting / 12 emails in - Do you mean Vidanta Member Services?
if so this is the correct dept to be having a discussion of options.

Basically - 50 % of TUG members bought at least one timeshare the way you did.
( we did in 2006 / from Grupo Mayan- Vidanta)
Lots of us went on to figure out how to use what we bought, found TUG for help and have better vacation experiences.

If you are broke - walk away and lose the $2500. If your concerns are something else - please explain.

Ok, so basically the total is $10,000 and I bought the right to use one of the rooms in the Nuevo Vallarta theme park. Apparently those contracts go for way more, and the seller convinced me that there was a flaw in some previous paperwork i had, which allows me to pay for only taxes of the new contract, etc... So i gave in. It was an impulse buy, and he made it seem like i could make tons of money and make my money back very quickly.

Now at home, im looking at this 7.5k bill and thinking, what have i done.

2. The @email is accounting@vidavacations.com They emailed me the Invoice and i replied asking for help on cancelling the contract.

3. I guess after reading into what it actually means, it just means that im forfeiting the contract that i signed up for (basically). I was at work earlier on my lunch, and after quickly googling, i thought it meant something like collections. I guess thats a bit of a relief.

4. I have read the contract, and maybe i did get an amazing deal on this opportunity, but i just think it came at the wrong time in my life. I just turned 30, have about 30k in student debt, and i wouldnt want to add 7.5k on top of that. I seriously was thinking "easy money", which was pretty naïve.

The $2500 i know are for sure gone, im mad, but not too mad, since it was an expensive lesson learned, but i just wouldnt want my name to be blacklisted in Mexico if i ever decide to buy actual property or inherit property (my Dad and Mom both own land in Mexico).

I appreciate the help!

You avoid this by paying what you agreed to in the contract you signed. You signed a legally binding contract and missed the rescission. They are within their rights to send the debt to a collections agency. Most people say that mexican timeshares won't do this and this is an empty threat, but the only way to find out is not to pay and see what happens.

I appreciate the quick reply! I was hoping someone would have experience with this and see if there were options for me. I have a feeling Vidanta will not be willingly giving me any ideas on how I can get out of it, but I was hoping some option would be out there.

I'm not familiar with Mexican timeshares but can u sell it? Does it trade with RCI?

Hello, yes it trades with RCI, and i could technically sell it, but i made the decision that i did not want to be involved with Vidanta (EDIT: Timeshares) anymore.

I want to give an update on my situation, and i hope this post helps more people in the future if they make the same mistake i did. Mistake in my opinion/ experience; I know some others can afford and can enjoy their Timeshare/ RCI, but I wouldnt. Anyways...

I spoke to a nice lady at Vidanta, who works in the Accounting dept, and after several emails and just 1 phone call, they sent me a settlement and release document which simply states that they are cancelling my contract, and basically i am retracting all negative activity/ not posting any negative activity, (Not that i ever did/ would) etc...

So basically, i am down $2500 bucks, but i dont necessarily see it as a loss. I was able to spend 3 full weeks within 3 years at Vidanta, so technically it paid off lol. Also, the contract/ Settlement paperwork doesnt mention at all that i cannot go again, so if i manage to find another free week, i can basically go again.

TL;DR

I was able to speak to Accounting and got my contract cancelled, but lost my deposit. No big deal, anyone can do it.
 
Sorry you lost your deposit, but at least you are out of it. Hard lesson to learn, but if you go again some other way, just know to say NO to the presentation. It is not worth it to get a free massage, 10% off your bill or a better room. Everyone gets to use the pools, beach and restaurants. Just enjoy the resort. :)

Exactly! Im not too mad, more relieved than anything.

I didnt know the meetings were optional, so if anyone ever decides to go, you DO NOT have to attend the meetings if you were invited.

Omar4578, very happy for you that you were able to find a resolution you could live with and felt good enough about. There are some very informative threads on this forum about attending sales presentations in general, but Vidanta in particular.

Look though them; there are a lot of folks on TUG who find them useful and informative and others who find them a poor use of valuable time, and it seems to depend on which property/company and less about what the "offer" is. But you there is a lot of information here and you can post before you go and ask for recent opinions about the sales presentations.

you can’t sell it… you can try but unless you have a holiday time it’s not worth buying (expensive) .
also you can exchange if you want to call it that but depending on the inventory that you ownthere isvery little that’s worth it in RCI
