Transferring Marriott Aruba Surf Club ownership

We have an elderly family friend who is unable to travel anymore. He wants to gift us his Aruba Surf Club week. I know it is not as simple as it sounds. I called Marriott owner services but they wouldn't give me much info since I am not on his account. Again, this friend is elderly and understanding all this is very hard for him. What I kind of understood from owner services was that we could be added as co-owners. But what happens when he passes away? Does anyone have any advice how to go about this?

If they gift it to you it has to go through Right of First Refusal and MVC would take it in this situation. Adding you as a co-owner might bypass this situation but I don't know of any real world examples where it has and MVC could balk if you tried to change the deed (certificate) later. At passing it would go to heirs or as stated in the will and it could be willed to you.

Aruba isn't really deeded ownership and since this isn't a direct bloodline relative, it would be subject to ROFR as Dean indicated. I would just go the route of adding you to the ownership with them. MVC should be able to answer how to accomplish this as Aruba is not deeded ownership.

That's why I put certificate in parenthesis. In this context it serves the same purpose.

If my memory is right, Aruba Surf Club owners hold Class B shares (I believe, maybe Class A (I've forgotten which share the residential vs business owners own, in Surf Club)), in the Aruba Surf Club Owner Cooperative. I'd have a talk with the Owner Modification Department personnel, about your best approach. If you are ADDED as an owner, you should be able to inherit certain benefits of (Developer) ownership, if the shares were purchased from the Developer. It might be worth it to hire a real estate attorney in Aruba to handle this for you. Personally, I'd lean towards the safer, more conservative approach to changing/modifying title; I am forever reminded of Nattalee Holloway's disappearance in Aruba, and, as a result, I am forever suspect of the Government.

Thanks for watching. We spent a couple nights at the Wind Creek resort and walked over to check it out. It was much nicer than we were expecting.

I hold 2 A Shares with a 3BR OV Platinum unit. I'm not sure I'd talk with Owner Modification in this situation since one is trying to skirt the transfer rules. I don't see where an attorney in Aruba would add anything other than aggravation and expense. I think the only question in this situation from a MVC standpoint is how will MVC handle a second transfer later and whether they will allow the ownership to stay qualified. I think they will but if it were me, I'd want to wait a full year before trying. Obviously there are other risks on the personal side from the current owners, esp if something happens to one or both in the interim. This issue has been mentioned on TUG quite a bit but I haven't seen anyone post that they have actually done so. Now I realize that it's likely there are those active that have done so and haven't posted the info.
