So I am still within my 5 days rescind period so I plan to do that. But they got me! I came to Los Cabos Golf Resort and their amenities included w "fractional real estate ownership" as our salesman posed it, are really great. Thats how they got me. It includes 8 massages, 3 chef cooked meals, airport transportation, and access to a yacht club and that's on top of the 3 bed/4bath villa for a week long stay. Honestly its a pretty good deal, but for the upfront cost and for only being able to use at this resort, it won't be worth it. It does also include access to a website called third home which was pretty intriguing. Anyway, I'm rescinding on Monday.

It seems you have been here a little bit and you know what to do. I have stopped by that resort only briefly so I can't comment on whether it is nice or not.
I can tell you someone is selling it on eBay for $950 and seller will pay the transfer fee. It is still on the market (meaning no takers).
BTW how much was the offer?

20k and then 2400 for each week use
 
It wouldn't be worth it to me. There are far better golf courses and resorts in the area that can be rented for less without the hassel of ownership.

Honestly, I don't think it is. If it was theoretically either $20,000 upfront and never pay a dime again OR $2400 per week without any upfront costs, it might be on the verge of being OK. But BOTH $20,000 PLUS $2400 (for now) for the week doesn't sound good to me at all.

Smart move rescinding. Make sure you follow all rescission rules to the letter.

And the other part was that they claim to pay me back by offering to rent my additional (3) weeks at the rate of 10k and then pay me 7600 for each time they rent it up to 22k per year. But obviously they could just claim to never rent it and then I never get anything for it.

Exactly! Good decision to rescind. As others have mentioned, please follow the direction to rescind properly.

Your guess is correct.
Think about it this way, if it was that easy and lucrative to rent, why would they sell it to you?

Oh come now! Have you no faith in human nature? Of course, nice business people enjoy making charitable contributions of $7600 per week to others, and thereby neglect their own profitability. Nice people do that kinda stuff all the time.

They had a whole "separate department" that handles the "marketing agreement" that can get my money back for the weeks that I own that I lend to them per that agreement.

They were open today so I went down there and they said that in my marketing agreement I have a clause that says it voids my 5 day rescind period. Guy told me we would have to wait for the owner until tomorrow because he was just the manager. I told him I was not going to take no for answer and I would be back bright and early since tomorrow is my fifth day. I got a text shortly after that said dont worry, we should be able to get it taken care of tomorrow.
 
The person lied. That statement is also illegal in Mexico.
But here is the deal. What does the cancellation section in the agreement say are your options for cancellation? If dropping it off at the resort itself is not listed, you may exceed your 5 day period tomorrow. Also, how are you going to be able to prove you dropped it off at the resort even if that was an option in the cancellation clause?

Go to any Post Office on Monday and send it via REGISTERED MAIL and retain the Postmarked Receipt. Your five day rescission is valid as long as it is Postmarked by the fifth day.

Why waste your valuable time getting shoved around at the Resort ? They certainly won't make it easy for you as you already have found out......

In Mexico the time period to cancel is 5 Business Days. Saturday counts as a Business Day. Sunday does not.
 
Oh thanks for the advice all. I will mail it also. My clause says to drop it off at the resort or mail it to the resort. I am still staying here at the moment so I will just do both. I am hoping it will all be fine tomorrow. I did pay upfront 36% deposit with my credit card. All else fails I will call my credit card company and cancel the transaction if needed.

So the claim was that you have a 5 day rescission period but there is a clause in your contract that says it voids your 5 day rescission period. So you allegedly have no rescission period and never had one.

That's believable. :)

I'd go the "overkill" route and go nuts on protecting myself with these sharks. By all means go to the office and get all manner of acknowledgements (in writing) that you dropped off your rescission. By all means, in addition, send out a registered mailing (or whatever they have in Mexico). Whatever provides me ironclad receipts. Take pictures on your cell phone. If you can, scan those rescission letters and receipts/proofs of mailings/whatever so that you have them in your laptop/computer, send yourself the scans via email (so that you have them not only in your "scanned documents" but also your list of emails). Do whatever you have to do so that you have evidence even if you lose or can't find the paper receipts. Maybe make the "office" aware that you have copies of those ironclad receipts.

Remember to keep copies of everything to show you cancelled and met the contract requirements. Let us know how it goes.
 
So when I went back on Monday to cancel everything, my seller told me oh yea my boss has no problem letting you out of the contract because you got such a great deal! I received my down payment back already, but I am going in today to get my refund for my marketing agreement because that was a separate charge of $400. Wish me luck! If not I'm calling my credit card company.
 
Did you actually stay at the resort? Have they remodeled it as that is an older resort outside of Cabo not on the Ocean. Don’t feel like you missed out as all the extra perks they said you would get could go away and you can do nothing about it.
 
Update!
I had to call my credit card company and get them to refund the $400 marketing fee because it was impossible for the sales department to answer the phone or call me back. My credits permanence is waiting on investigation.
I did stay at the resort, recently left a review. It is being updated and the new villas are currently being established and they are houses, big 4 bedrooms houses that are what they are selling the new vacation club ownership for Bloomfield Vacations, I think they have 2 other places and are also in Mexico. They said it is a passion project of a rich dude and he is doing it for his autistic daughter and it has a charity, man so many great things that company was doing, haha. But the homes were beautiful with spectacular 360 views of Cabo and it is a little drier so less humid as it is away from the ocean. And it trades into this site called third home which exchanges time but in some peoples actual mansions. Which I have been meaning to ask, does anyone here know how to get into that club?
