My husband and I purchased a right to use from Sunset Group in January of 2020 which we would like to get out of or sell. This is for Sunset World which consists of several resorts – in Cancun and surrounding areas.

I am willing to pay Sunset to get rid of this, but I’m unsure of how much to offer or how to proceed.
I am so overwhelmed with the information I’ve read so I thank you for your assistance.
Stats for resort:
- Studio Room
- We have one week and one VIP week to use (The VIP week doesn’t require maintenance fees to be paid unless we use it). They are floating weeks (can’t use Christmas, New Year, Thanksgiving or Holy Week)
- No loan
- Yearly maintenance fees of approximately $810/year.
- Also an every 5 year fee equivalent to a maintenance fee.
- Started an email negotiation with Sunset (it was with a customer service representative)
- They would not do a deed back
- Sunset suggested we:
- Switch to biennial or
- Pay 2 maintenance fee years and then only pay the 5 year fee consistently
- This offer supposedly expires Oct 31, 2024
- Found Tugs and started reading.
- I see in my contract that if I sell the weeks, I have to pay Sunset 5 years of normal maintenance fees.
- I live in West Virginia.
- Sunset has offices in Cancun and at least a mailing address in Florida.
I am willing to pay Sunset to get rid of this, but I’m unsure of how much to offer or how to proceed.
- Should I try to sell on the open market first (even knowing I would have to pay 5 weeks to Sunset) or try further negotiation with Sunset? (I also would incur monies to sweeten the deal by paying maintenance fees for the buyer)
- Has anyone successfully negotiated with Sunset or stopped paying and knows how Sunset handles non-payments?
- Should I continue in the email format with negotiations or send certified letters to the address in my contract?
