I recently purchased a 2 bedroom lock off unit (Floating Platinum season), about 1300 Sq Foot, at the Broadway plantation from ebay at a crazy low price. Usage starts in 2008. The ebay listing said that the ownership begins after the title transfers to the winners name. I am now working with the title company called Timeshare Title Co. 2008 maintenance fee (plus taxes) of about $962 were collected at the end of auction.

Here are my questions:
(1) I am asking the seller (who is running a ebay timeshare business and also is the current owner of this timeshare) to put a decent 2008 summer week on reservation in his own name. The summer weeks are going fast at this resort. When the deed gets recorded, I will get the week transferred in my name. The recording in South Carolina seems to be taking over 4-5 weeks as per the discussions on this board.

However, the seller is saying that he does not want to get involved with booking a 2008 week. He is saying that the ownership begins when the deed gets recorded in my name, which will take atleast 2 more months. However, his ebay listing did not say that the week can not be reserved beforehand.

Am I out of line in asking him to reserve whatever summer week (june, July, August) is available? Does the fact that his ebay listing included "ownership begins when the deed is transferred" takes away any responsibility/courtesy on his behalf to spend 10-15 minutes with SVO to book the week ahead of the deed transfer?
(2) Is the 2008 maintenance fee (plus tax) of $962 correct? This is 2 bedroom lock-off platinum season.

Thanks

June, July and August are prime time in MB. Those weeks maybe already reserved for this year. I would call Starwood directly and check to see what is open and what are your option for this year.

This is the kind of thing that needs to be settled before you bid on an auction. It would be nice of the seller to make a reservation for you, and I think you should ask, but since he did not make that stipulation in his Ad, he has no obligation to do so. Good luck!

FYI - the MF number of $962 sounds wrong - I think it includes the SVN fee that you don't pay as SVN doesn't transfer with the purchase of a resale week. They (the seller) owes you $100 +.

Did you but this wek from one of the BIG ebay sellers? - because they usually have a department that handles reservations for a small fee.
It is rather late in the year to get a July resie but early June, Late August could work - IF they would agree to making it for you.

Starwood will not give me anything

Starwood needs the ownership information to even give me a clue on what is available (which I do not have at this point). Starwood needs to look into the account, they refused to give general availability to me. The title company person did call Starwood and most of the August weeks are available at this point.

Did the seller agree?

I'm a little surprised. I would have expected them to take the view that the amount listed is in the auction is what you agreed to pay.

Yes, I am getting the refund at closing

Yes, the seller has agreed to pay! The amount of $962 was listed as Maintenance fee plus Tax in the auction (which turned out to be incorrect as it included the SVO membership fee). So seller is going to refund the money. These resellers try their best not to earn negative feedback on ebay.
