Rescission Question

This is an update regarding my rescission with Bluegreen. My wife and I signed into a timeshare on 9/15, I sent a rescission letter on 9/18 which was out for delivery on 9/19 but I guess they weren't able to deliver or have anybody sign it so then the status changed to Available for Pickup. This morning I go to check the tracking number and in red it says Delivery Attempt: Action Needed, saying that I need to schedule a Redelivery or the letter will be sent back to me. I scheduled a Redelivery for Saturday 9/23. I've also already sent a second letter on 9/21 through Certified Mail notifying them it's my second attempt of sending them a rescission letter. At this point I'm planning on sending everything back in a box with a third letter out this evening after work. I'm still within my 10 day period according to Tennessee law. Is there anything else I should do? I want to make sure they get it.

Why would you want to attempt a redelivery on a Saturday? What office works on a Saturday? They're not there on Saturdays. My advice would be to change it to Tuesday 9/26 (but I doubt that will do any good either).

Again, your tracking numbers PROVE you mailed it on time. You need not do another thing as it is the Postmarked date of mailing which counts and entitles you to your rescission.

Editorial; I have seen this issue with Bluegreen before. I am guessing that they do not receive street delivery and only have a Post Office Box. It is likely that they pick up their mail only once a week.

Their negligence in not picking up their mail in a timely manner will not affect your rescission request; it will only delay it.

Good point. I'll change the redelivery to Monday if anything. Thanks for your response. I also read on a past thread that I can call my credit card company to initiate a case to have my deposit refunded to me. Is this possible?

You can call them if it will make you feel better, but I believe you are only spinning your wheels by making more work for yourself. If it will make you sleep better than do it.

If you go this route then I am not sure if your card holder will cancel your card and issue another or not.

Thanks again for your insight. I plan on sending back everything that was given to me today with a copy of my letter.
 
Caution - Why send back all the documentation as you may need it in a dispute? Hang on and just do the very straightforward and simple stuff to comply with rescission requirements.

Read your rescission materials again. For Marriott, you can even send an email to a specified address. You may be able to back up your other efforts with a simple email.

Think twice about engaging in follow-up discussions with sales personnel and managers. You are beyond that and will probably only cause risk and frustration for yourself. Do this stuff in writing.
 
Good news! Just received a Refund Receipt from Bluegreen via email stating they refunded the $49 for the owner orientation. I ended up sending them an email as well this morning. Will I receive the rest of my deposit later?
