Rescinding Tahiti Village

I too wanted to cancel my contract (with Tahiti Village) once I got back to Canada. I filled out the revocation form and sent it via registered mail quick delivery and asked for email confirmation of acceptance.

Then I faxed the revocation form along with the receipt from the post office.

I also sent a telegram which puzzled me because you can't sign it.

I also emailed and sent an attachment with the copy of the revocation form and the post office receipt of the registered letter.

When I received confirmation of delivery via registered mail (mailed Monday am delivered Wed am) I printed out a copy of the signature of the acceptor which could be downloaded from the Fedex site.

Then I faxed another copy of everything including the proof of delivery signature.

Whew...overkill hey? But there is no way they cannot say they got it. Now I just have to see what they do from here. Anybody have experience with revocation with Tahiti Village (Consolidated Resorts) and how long it takes to refund? Is it 15 days from when they received the form?
 
I have a question about Tahiti Village. We went to a "owner's update" and quickly realized that was just code for "we want to pressure you into buying more". They talked us into selling back (Quit Claim Deed signed) our existing two bedroom, repurchasing a one bedroom (new deed) and a two bedroom (new deed) at another affiliated resort for trading purposes. While it made sense to us at first we changed our mind when we went to actually see the resort. I know, I know...we shouldn't have signed site unseen. We actually asked them to take us over but they just kept telling us how good the trade value was.

Long story short, we cancelled the two new purchases the next day by filling out the revocation form and sending it as instructed. We have confirmed receipt. Should be no problem.

My question is this...Does the Quit Claim Deed hold for the original purchase? Both parties signed it and it was notarized at the resort. I hope so because I do not want to own a timeshare here anymore.

It sounds like you followed the rescission process correctly - your rescission should "un-do" the whole thing.

Nothing wrong with buying timeshares sight unseen. We bought our 1st timeshare that way in 2002, then another later that year & 1 more in 2005 -- all resale.

The mistake is buying timeshares from timeshare companies at full freight -- a mistake only in the sense that nothing the timeshare companies sell at full freight is worth the money.

Buy timeshares resale. Save thousands.

BTW, the most obnoxious timeshare seller we ever encountered was at Club de Soleil out in Las Vegas.

I am not an attorney or accountant but I do not believe that your signing a quit claim deed will cancel your ownership of the original week you own. Since you are not planning to go through with the new purchase, it would seem that the whole transaction will cancel out. The resort will undoubtedly decide not to file the quit claim deed at the court.

If your original week is not paid in full, they will want to continue to collect payments from you. If the week is paid off, it would be in your best interest to try to sell it on your own, or perhaps donate it to charity, if you no longer want it. Study the information contained in the "stickey" at the top of this forum for tips on how to sell a timeshare.
