Rescinding and USPS

On May 10, we purchased Hyatt points from the developer.
Seven (7) days later we sent our recission letter & copy of purchase agreement, certified mail & First class to the Florida address listed in the purchase papers. This was in a full size 9x11" manila envelope.
Nine (9) days later we sent back the printed paraphernalia, including bag, plus a copy of all we sent in first recission envelope. These were also sent certified, but in a Priority Mail flat rate box. We reiterated again in a 2nd letter in the box we were exercising our right to rescind the purchase, signed and dated etc.
Both were sent within the 10 day recission period.

My husband's been checking on USPS site on the receipt. Amazingly the first envelope has not been delivered yet by USPS, and it's been 9 days since we sent it. The tracking comments just say the envelope is in transit and will arrive later than expected. Looks like it went out at least once from the USPS Orlando distribution center. The envelope was sent with electronic return receipt. We were surprised it took so long 5 days for the envelope to go cross country.

The Priority mail box was delivered, but it didn't have return receipt requested on it (oversight of Postal clerk when it got sent, and husband didn't catch it).

I'm afraid by the time Hyatt's documents admin dept gets the recission letter(s), it will be a couple of weeks at least since we purchased. And so they'll go ahead and send closing deed documents to county in Arizona. Thank heaven we included another recission letter in the box. We've double-checked the recission address & attention to dept, multiple times before and after we mailed.

1. Should we be concerned? Will the USPS delivery delays affect the recission?
2. Will Hyatt charge us to retract the deed recording?
3. What should we do next? Perhaps call their documents department to see if they received our recission letter?
Does anyone have a phone number for the Hyatt document administration dept?

NO NEED to be concerned as it is the Postmarked date that rules the roost. The Postmark indicates it was mailed on time. You have no control over the actual delivery.

Obviously your Certified Letter had a tracking number, but so did your Priority Mail Box. Print out both those tracking numbers to show their activity and retain for your records.

They don't have to notify you of receipt, however, they do have to act on it. Refunds usually happens within 45 days if not sooner.

Sit back and relax as there is nothing more you can do at this point.

Congratulations; how much did you end up saving yourselves?

Thanks @TheTimeTraveler. We saved about $14K. I expect will have to spend some of it on a future Marriott Vistana cross point system :unsure:

No, there is no charge to retract.
There is no need to call.

Happy to report we got a credit on our credit card today for the rescission. Much faster than we thought it would be.

Strange thing is the first rescission letter we sent certified with electronic delivery receipt.
Checked almost every day, and USPS never showed it was delivered. Just said things like delivery will be late by etc. Finally after 2+ weeks USPS closed the receipt with some phrase that they couldn't provide the delivery tracking. We think our envelope was delivered but whoever delivered screwed up and didn't mark it in their system. Either that or they completely lost the envelope, and Hyatt processed the rescission from our 2nd package notification.

So lesson learned, don't trust your rescission to just one letter. USPS can mess up too!

So lesson learned, don't trust your rescission to just one letter. USPS can mess up too!
I also suggest just sending a plain old first class envelope, nothing special. It is 100% recognised form of notification and it only costs an extra 55 cents.

Another seldom used option is a "Certificate of Mailing" which costs $1.50 plus postage.

A Certificate of Mailing proves the "From", the "To" and the "Date it was mailed". It does not prove the actual date of delivery, nor does it have a Tracking Number.

Certificates of Mailing are actually rarely used because most people have never heard of them.
