Removing deceased spouse's name from deed

Hi everyone,

From a Search of the forums it looks like death is something a lot of us have faced recently, but I didn't quite find an answer to what I was looking for. My in-laws own(ed) at an Exploria resort, Summer Bay Orlando, and both of their names have been on the deed since inception. Father-in-law just passed. My wife spoke to the resort initially and they indicated they would only need a Death Certificate (sealed original or copy, happy to provide either way), but apparently her mother just got a letter indicating she'd need the services of a lawyer as well as the death cert?

Just wondering what you all have run into, either at Exploria (pretty small network) or elsewhere, maybe in Florida specifically? I know if Mother-in-law wanted to add, say, my wife to the deed at the same time as removing my wife's dad, then we'd definitely need a lawyer much the same as if it was being transferred to $1 to someone to "get out" of the timeshare. But just to remove the name of the deceased?

Would one of the "$150" lawyers people talk about that handle FL timeshare transfers be someone to use if we had to?

You could reach out to LT Transfers to get their advice. A lot may depend on how title was held. Right of survivorship? There may be probate involved. I would recommend not adding any other names to the deed. Simply remove the deceased. Adding your wife would put her on the hook for annual MFs and also that when her mother passes, she owns the week. At least by not adding her, she doesn't need to take the resort week upon her mother's passing.
