Question for my Aunt selling her timeshares

My aunt has 5 timeshares. Her husband bought all of them from eBay many years ago. She's been kind enough to let us use her Wyndham Bonnet Creek timeshare several times over the last 10 years.

Her husband passed away many years ago.

She now wants to get rid of her timeshares but doesn't know where the contracts are.

What can she do?

Try Wyndham Ovations in which she can give back for free. Her Wyndham timeshares likely worth $1. Don’t give any upfront money to TS resale outfits. 99 percent are scams.

can’t she check her paperwork to see where they are?

You might be able to check the county registrar where the timeshare is located. If you have to have the deed, you can purchase them online for a minimal amount.

I've done as @dayooper suggests. I needed a copy of one of my deeds in order to sell it. Since deeds are recorded in the county where the timeshare is held, it was just a matter of going to that county's website and requesting a copy of the item. I think I only paid like $5 to download the copy.

If there is a membership-type ownership, where there is no recorded deed, a call to the resort business office should suffice. As for disposing of those kinds of ownerships, I've found the same business office staff can point to the people who would take the unit back (or dissolve the membership), as applicable. In one case, all I was asked to do was write a brief note explaining why I wanted to cancel the membership. I think I sent it in as an email - no stamp required. :)

Good luck to you and your Aunt in divesting yourselves of the ownerships you no longer want.

FYI, your aunt should obtain a copy of her deceased husband's death certificate. Having this will help whether you are able to return the timeshare to the HOA or sell to a third party.

I assume that the timeshares are in both their names in JTWROS. If so, even though the property passes to the survivor upon death, you will need a clear title for sale to another party. Each county has different requirements -- some you can just file the death certificate, others are more complicated. A reputable closing company will be able to help you once you find a seller (though the extra form/filing may be extra cost).

If it is only in the husband's name, then you can likely let them go without doing anything. They will just go back to the HOA after they do not receive the maintenance fees for the given year. YMMV.
