PURCHASE MEMBERSHIP VIDA VACATIONS - NUEVO VALLARTA MEXICO

Hello everyone,

I just want to bring this to your attention about a so called membership my husband and I purchased in Dec 2019 at Vidanta resort -Vida vacations whiile on vacations. We attended a presentation and were duped into purchasing a membership that is not valid. I am a time share owner of another resort in Mexico. During the presentation, the sales manager informed us they will use our timeshare as equity to purchase a membership into the Grand Mayan resort. She took us over to the Grand Mayan and showed us what we have purhcased. It is a beautiful resort, so we came back to her office, and completed the paperwork etc of using our time share as equity for this new membership at Grand Mayan. We paid additional $5,000.00 to them, and were rushed into signing the contract. There were a lot of fine prints in the contract which needed to be read in detail.

After signing, we met a Mexican friend and explained what we did. He worked at Vidanta as well, He informed us that is not what we purchased, and advised us to go back to see the manager. We went back to Vidanta. met with the Manager Luke Kurik who we dealt with during the transaction. He is a Canadian, and informed us that we should not worry that everything is fine.

Upon our return home, we received a few emails from Limitless Vacacation welcoming us as a new member. I also received emails and phone calls from Timeshare resale to start the process to sell our timeshare. We had to pay almost $2900. USD to them. I wasn't going to throw away more money.

I did not go through with it, and explained what occured. I contacted Vidanta and a manager explained that we only purchased a two year membership with Limitless Vacation. We were scammed into believing we purchased at Grand Mayan. I work deligently with Vidanta's manager to get back my timeshare. We were fortunate it was retruned to us.

I have been working with Luke Kurik since Jan 2020 to present to get our refund back, and he kept insisting that we cannot get our refund back, To date we have not use anything for a so called membership. Limitless Vacation informed us we are not member as well.

Can someone advise the next step to take to get our funds back? I informed Luke we will be getting our lawyer involved now as the entire transactiion was based on lies.

Really want to get our refund back.

What you bought in 2019 is called an "exit package" that allows access to Vidanta / Grand Mayan via a travel club called Limitless Vacations.
This access is normally during slower seasons when the resort is not full
It IS NOT a Vidanta Grand Mayan ownership - as that would cost more than $ 5000.

I would suggest you contact Vidanta Member Services and not the salesperson Luke Kurik
VMS is likely who you spoke to regarding the cancellation of the trade in .

Unfortunately this is close a 3 year old situation and I am not sure what outcome is possible.

As we have mentioned already, your request has been reviewed however the money is not refundable. The company does have to go by what the contract states and you will find everything stated in the contract is honored. To get access to the website and membership benefits you will need to call Limitless Vacations, 1-858-999-9102.

Thanks for your feedback. As per my email, they sold us as if we were purchasing into Grand Mayan and using my time share as an equity.

If Limitless is telling you they have no record of a contract for you, your only recourse is to write profeco. You can explain that it was sold as if you were buying a membership to Vidanta, but they may only care about the fact that what you were sold in the contract that you should have read when signing, Limitless, has no contract for you. Profeco should push Vidanta to make that right and at least make sure you get the contract you bought. Unfortunately, you let Sales string you along for two years and you may not get those two years back.

Paying to get lawyers involved is likely throwing more good money away. No matter what you thought you bought, apparently you bought a 2 year vacation club membership and just because you never used it doesn't mean you can get your money back 3 years later. They would have honored the contract for the 2 year membership which expired a year ago. If you had read the contract and tried to cancel within 5 days, you likely would have gotten out and received your money back even though exit package/vacation club memberships aren't required to refund even during the 5 day rescission period. If you had bought a time share from them and tried to get out a month later you would still be in the same situation except you would have likely paid at least double as a down payment and another several thousand in the last 3 years and you still wouldn't be able to cancel and only what was written in the contract would be honored.

It's a very expensive lesson to learn but you will probably never sign another contract without reading and understanding it again.
