Oregon House Bill 2373 regarding timeshares

What I read about this is that other states have this type of rule regarding selling timeshares. I didn't read the entire bill but did skim through it. It kind of looks like a fee for a class that has an ethics lesson along with other instructions in a 14 hour class. Misdemeanors and felonies regarding timeshare business may disqualify a person from receiving the license. I didn't notice anything about selling or renting a persons own personal timeshare so I'm guessing it's still fine.

Sounds liked a good legislation, in Oregon in the near future timeshare salesman must have a license. Excellent!

more laws are never going to accomplish anything if the existing laws arent being enforced (like florida)

There are many on the Oregon Coast and a handful inland. Worldmark and Vacation International are the memberships we own that have resorts in Oregon.

I'm not sure what category timeshares fall under. Some are deeded properties so these would require county recordings. Many are memberships that aren't required to record sales to the county as there is no deed. I thought all sales staff at the resorts had to have a real estate license to sell timeshares. In Washington it takes about 90 hours of education and passing the real estate examination then paying the fee to be a licensed realtor.

What this legislation does is require more of a certification than a license even though it is a license. The requirement is only 14 hours of training and a fee per each applicant. I'm not sure if a person could do this without a broker in charge. It would be an opportunity to look legit if the license can be had by anyone. I'm not sure how this affects sellers that aren't licensed that are selling other peoples timeshares.

Simply require all Members of the Sales Team to include Congiere Staff to have a Real Estate Licence and be subject to all ethical standards concerning real estate. Require all Employers of such to maintain E&O Insurance with a $1mil per claim. Require that all Sales Presentations be fully recorded and that copies of these Recording be provided to the buyer at no charge at the time the Contract is signed. Require that all oral representations be part of and incorporated into the Contract. That these laws shall apply to all Sales within the Borders of Oregon and/or if the Timeshare is located in Oregon no matter where the Sale takes place.

It would be nice if all Jurisdictions with the USA adopted such standards. Though these might destroy the Timeshare Sales Business as we know it.

I don't believe Hilton or Hyatt have any TS in OR.

Worldmark/Wyndham is one of those trust programs - points, no deed. They have a licensed real estate agent, Dave Carlson, who works with the sales people across the state, who do not have real estate licenses. Dave is also the agent for sales of fractionals at Whalepointe and Seaside. Fractionals are deed-based.
