No newbie but screwed up badly: owner at Marriott Mountain Valley Lodge

I've owned at Marriott Mountain Valley Lodge since 1995. Two knee replacements in the past 3 years--yes, elderly. With various carers & sitters, my Marriott correspondence has been cached since 2023 so that I just found them unopened TODAY-- after I received a court summons for nonpayment. Please help: I'm no longer up for travel. What I would like to do is deed back my unit. The last bill I can find was March 2024 notice of delinquency & payment plan offer for $1995...now of course doubled. How do I proceed? Who do I call (Financial services? Member services?) and PLEASE: what do I say, and what do I NOT SAY? Thanks for mercy.

What type of unit and season do you have
It could possibly be worth the past due maintenance fees to someone
Maybe not
But it is worth checking
 
Is it an actual filed court summons with a court case number, or is it a demand letter threatening to take you to court?
 
This is probably one of the phases and notices required by law to move through the foreclosure process. If you want out, this seems like it is a good way to go about it. They will foreclose and take the deed back. You could try contacting them asking if they will take a deed in lieu of foreclosure.

a legitimate summons would be delivered by a process server or law enforcement.

Thank you for comments and queries! This is an actual Summons with a Case Number. My unit is a 'silver' (winter) studio at Breckenridge (Mountain Lodge). We paid $15,000 outright in 1995.
Dioxide45: Please specify which office I need to contact: the 2 most recent letters (2024) are signed "Financial Services Department, Marriott Resorts Hospitality Corporation" and include a Financial Services phone number. Someone has suggested that speaking to Membership is a friendlier approach...(The Summons itself offers only a Edwards County Court telephone). Do I simply speak to a Marriott Financial Services rep and straightforwardly state my wish to offer the deed in lieu of foreclosure? Or are there other protocols? Having fouled up, I don't want to go about this in a less than appropriate way. --Thanks!
 
ps. One of the posts I read suggested that they are not obliged to take all deeds, depending on their numbers of foreclosures. In the Class Action Summons in which I am named are 8 other names--some of whom are 'Estates of'!

Genuinely interested as this would be the first time ive ever heard of someone being taken to court for non payment of maintenance fees (you mention it was paid off long ago). I would truly like to read what the language says or is asking you to do.

There's no specific language. "You are hereby summoned and required to appear an defend against the claims of the complaint filed with the court in this action....copy of the complaint may be obtained from the clerk of the court....This is an action to foreclose MOR's assessment liens against the following..."
I can post more late this afternoon if needed. HERE'S MY QUESTION: DO I HAVE TO NEGOTIATE WITH THEM ON MONEY OWED, OR TERMS....IS IT SOMETHING I NEED A LAWYER TO TRANSACT? If it's a straightforward foreclosure for which they will accept the deed, is this in lieu of funds I owe them?
 
If you cannot travel anymore, and you don't want the week, let it go back to Marriott.
 
Sounds like a judicial foreclosure in Colorado.

It sounds like this is just one week and there are at least 2 years worth of fees due. Financially it doesn't sound worth it to try to salvage the week even if it's a Platinum week. About the best you could do would be to break even by paying the fees and penalties then the 2026 fees. Of course you could try to rent out a 2026 week but likely missed the best week already if Platinum. If not Platinum then it's even less likely to be worth considering. Hopefully they'll just foreclose and take it back without coming after you for the fees. Also hopefully they will not report this as a foreclosure that shows up on your credit. If you're follow up over the next 6-12 months and update this thread, it'd be helpful for a lot of people.

agreed on this being a foreclosure proceeding vs an effort to sue you for overdue fees but id still like to read the details as we all learn from stuff like that!

the biggest question to decide your options going forward is do you want to remain an owner of the timeshare?

MVL is in Colorado, and that is where id expect any foreclosure proceedings to take place and Colorado is a non judicial foreclosure state so id very much be interested in knowing why they would choose this route?
 
The fees are so high on that particular resort. I know that with my Chairman's Club points, I can book those off-season weeks for a pittance, really it's likely less than 100 points per night.
 
Maybe contact them and ask them if they would like a deed in lieu of foreclosure. You would be saving them time and money. As an aside, I have never heard of a summons being served without the Complaint.

He said Silver but he also said winter, So I'm not really sure which it is as it cannot be both- Winter is all Platinum.

As noted, it wasn't clear. But the fact remains that it's not worth saving from a value standpoint even if Platinum.
 
Again, thank you all for your thoughts. I spoke with Marriott financial advisor Brooke today at 12:45p. She said too late for deed-back process; they are simply going to proceed to get their property back. No fees, no court charges, no reporting to affect credit...(though clear to me their Court Summons naming me was printed in Edwards County newspaper...) Upshot: Marriott has turned it over to a collection agency and I will continue to get calls and threatening letters until foreclosure is final in June.
