Hi.

I've reserved a [Marriott Exchange] and now have the same calendar week at another Marriott resort on HHI, so I need to rent one of them. I have never done that before. The week I want to rent I traded to get (I'm a multiple week Marriott owner and traded through II to get it). Do I have to go through II or Marriott? Do I do this on my own? If so, how do I go about actually getting the renter checked in since the reservation is in my name? I'm sorry for asking such silly qustions, but I want to ensure that I do this right.

You should just cancel, forfeit your exchange fee, and get your deposit back. If you get caught renting an exchange, II can confiscate your deposit, exchange, and fees paid.

I don't know about II but RCI states you can not rent for a PROFIT, if you are willing to rent for what it cost you....and NOT A PENNY MORE...then it is fine with RCI....Of course, i don't know about II

II and RCI are different companies with different rules - II does not permit you to rent exchanges, period.

Also, with RCI - it's not what it cost you - It's ONLY the exchange fee and guest certificate.
You may give a vacation to a friend or family member via the RCI Guest Certificate; however, you may not receive any compensation beyond the price of the exchange and Guest Certificate fees. Compensation includes anything of value, even another exchange vacation.

Thank you for the correction...Is that information from Madge or RCI? Because i have read on another forum from RCI that it is ok to exchange exchanges

Oh wow... bummer. That's disappointing.

Okay, for the other one, it's a direct Marriott booking (not through II). However... it's the unit I'm buying and the seller of the unit booked the week and I'm using it. Can I rent that one?

I know this has been debated before, and that I am relatively on the new site however I think a good lawyer could contest this. As you have pointed out the word "exchange" does not have the word "fee" after it.

Interpretation is 9 / 10ths of the law. The argument could be made that the word "exchange" by itself constitutes the week that was given to RCI, and the week obtained from RCI, in addition to the fee itself as an entire entity, and NOT just the exchange fee. The reason being, if the weeks were not exchanged in the first place there would be no fee for RCI to obtain.

I.E. my week, which I paid $500 for was given to RCI. In return, I got another exchange and paid the $69 guest fee, and $149 exchange fee (not in RCI so not sure if these are correct, but for the purpose of my example).

In THAT context, it means that I would not be able to get more than $718, not just the $218 exchange fee and guest fee. If I got $719, then I would be being compensated as I made a "profit" (not really considering all the work that would have to be done, advertising, searching for exchanges, etc.)

Just my 2 cents, and a personal note that I would never attempt something like this myself but it could be said and argued.

If RCI catches you and cancels your exchanges and membership, where would "the good lawyer" contest this? RCI is the judge and jury and holds all the cards.

That may be your opinion - but that's not what the rules say.

We've actually had owners lose their deposits, exchanges, and fees paid, including weeks they had rented out, because they got caught renting exchanges.

If you quietly rent an exchange that you can't use to a friend or family member who understands the situation, you should be OK. If you start a cottage industry renting exchanges, you are likely to get caught.

If it's okay to have someone else on the phone to pay for exchange and guest cert with II, which is effectively renting the exchange, then why would renting at cost not be the same thing?

Please provide a link to the source. If a regular Rep. told them they can do it, that does not override the terms and conditions that you agree to when you become a member, but Reps are known to tell people they can rent an exchange. I had a II Rep. tell me this just recently.

BTW - "Madge" was RCI's official Rep. on TUG, so "her" posts were not just hearsay or opinion.

Personally, I couldn't care less if people rent exchanges or not, but I think they need to be aware of the risk they are taking, and they should fully disclose the situation to a renter.
