Need opinion on Wyndham contract

OK here is the deal.
Three years ago, BEFORE we found tugs we bought retail from Wyndham.
Last week we get a call from the title dept and they tell us that we need to sign a new contract because there was mistakes on the old one and have to have it signed and notorized again.
What if I dont want to resign the new contract?
Are the points voided? Is the contract still legal?
Looking for opinions?
Anybody else run across this from Wyndham?

Interesting. A Developer contract is "wrong" and they need you to redo it? Go to the mat to get out of it! DO NOT sign anything they request except an agreement to return the purchase (think about giving up some $$ & any fees paid in return for what I assume is the use you got the past 2-3 years).

Maybe you can get out of a bad deal (any Wyndham Developer purchase, due to cost, IS a bad deal). Good luck!
 
We bought a small contract in 02 our first.
We updated in 07 to more points at a different resort.
Then we found tug shortly after.
The contract is not paid off and we do have a fairly good rate with Wyndham.
We have about 7 years left on the contract.
Any body know a good lawyer you would recommend to look over both contracts. Just PM me.

In that event, spending a few hundred dollars on a lawyer would be wise---if you still owe seven years on the purchase, it would be to your advantage to get out of this deal and (assuming you still enjoy Wyndham) buy resale.

You may find that the error is not sufficient to allow you to void the original, but it would be worth looking into.
 
It would all come down to what the mistake is and is it material to the contract. I would ask them to walk you through the changes and need for the changes. And ask them what will happen if you refuse to agree to the changes they are requesting.

If it is failure to make a required disclosure as required by state law, then you might have a basis for challenge.

However it is an administrative error, or something minor, then trying to void the contract would be problematic. And generally speaking, the failure to properly memorialize a contact does not nullify a contract. Particularly when the performance of the two parties has indicated their intent to be bound by the contract, and/or those parties have received the benefit of the contract.
