Need advice on getting out of timeshare

Hello everyone and I am glad something like this is out on the internet!

Long story short, one of my parents got into a time share a long, long time ago...I somewhat remember it because we had gone on a vacation, and then they disappeared into some office to sign some stuff towards the end of the vacation...

Anyway, fast forward to present and my family new we had this time share. From documents I can find, there looks to be a standard membership paid to RCI and then annual dues paid to Florida Vacation Villas Club. It looks like the time share has been paid off and only the dues/membership are the only reoccurring fees that I can find. My family never, ever used said time share and it was just money that just blew away in the wind... Is this the type of timeshare that needs a lawyer, can it be given/donated away, can I sell it to someone legally and be done with it, or can I literally call, I guess, Florida Vacation Villas Club, and tell them we want to stop being a member of the timeshare? Another possible hinderance...the parent of mine who is the owner of the timeshare, recently just passed away...so unsure if that complicates things.

I appreciate any advice/help!

Is the timeshare just in the name of your parent who passed or are there other people on the ownership?

To my knowledge and paperwork that I can find...just the parent who passed.

Would it be "safe" to just call up the timeshare and let them know what happened/what we planned to do?

As this point, if the parent that passed is the only one on the deed, then it would need to go through probate to get transferred. That could be expensive to take care of. Have you tried contacting the resort in question and asking them about your options. Are you trying to currently probate their estate? Are there any still any living owners on the deed?

You can have a go at contacting them to tell them that the owner has passed. What they may do is say heirs are obliged or required to take it on, which is not true.

Some brands, such as MVC wont participate in probate or take it back if it isn't in the name of a living person, so that can be an issue. If you abandon it and stop paying, the estate remains liable and you can't technically close the estate without resolving the matter.

Understood. I called up my legal insurance that I have through my employer, and the representative said, possibly that it would need to be transferred into someone else's name (a living family member), and then from there have them possibly purchase it back?

Don't expect them to give you any $$ for it, and possibly you will have to pay them to take it back. Don't change the ownership until you know that the specific resort and brand have a process for deeding it back and how much that might cost you.

There are reasons people abandon them in these (and other) circumstances.......

Honestly, we just want to be out of it. If we get nothing out of it, we are all ok with that. We just don't want to deal with the annual dues and membership fees that seems to be paid yearly...

Of course, I would not switch anything over. Like I mentioned, I see RCI membership fees, as well as annual dues paid to fvvclub (Florida Vacation Villas Club).

Just attempted to call fvvclub and they are saying to email them through their automated answering system, which I guess I can do.

Whoever told you to transfer it to a living family member to allegedly enable you to have the timeshare entity PURCHASE the timeshare back from you obviously has no clue about timeshares. They won't give you a dime for it. Instead, they'll likely tell you that you have to pay THEM many thousands of dollars in order for them to take it back from you.

Since you have an insurance plan from work, don't just call an attorney who may be close to you after doing a zip code search. Call a Florida attorney, preferably a real estate specialist and preferably in the heavily timeshare-saturated Orlando area.

Theoretically, you might be able to give away a timeshare on a website like TUG but I'm afraid Vacation Village timeshares in either Weston or Orlando have no value. Check out ebay ads in which VV owners try to entice people to take their timeshares off their hands by offering free 2026 stays, prepaid credit cards, etc., etc., etc.
