MVC Insurance claim question

My husband fell and got seriously hurt while visiting a Marriott Vacation Club resort. We always get the annual vacation club insurance. The reservation was made with banked 2024 vacation club point to use year 2025. Which travel insurance policy do I use to file a claim, the one for 2024 use year or 2025 use year?

I understand you would use the 2024 policy. However, were you hurt on property? There is a chance your issue would be filed against the properties insurance. Depends on what cause the fall.
 
I've already been contacted by the resort's insurance company. He tripped over the duvet hanging off the corner of the bed and shattered his kneecap. I have no idea what to expect from them they reached out to me.

I am no attorney, but I don't think that would be the fault of the property. Accidents happen I suppose. It certainly sounds painful.

Did you incur any costs associated with the fall and injury? Was any or all of it covered by medical insurance? Did it happen in the USA? The trip insurance will only cover monetary losses. So if you had to pay for medical coverage or to cancel part of the trip, then those may be covered.
 
We don't even have any bills yet. We have really good insurance everything should be covered except $250.

I don't have anything to add except for sympathy. It always seems like some of the worst injuries occur in the dumbest of ways... and I'm not calling your husband dumb, his accident sounds like something I'd do. I hope he will regain all of his mobility and that the recovery process won't be as bad as you probably fear.

And this is my self-reminder to make those beds right away after getting up, and be sure the duvet is off the floor all the way around. Ouch. So sorry this happened to you. I'm glad you have good insurance and need only worry about his recovery.

Most liability policies have medpay, which is no fault coverage for medical expenses up to (usually) a small amount. Be sure to ask the company about medpay. It certainly would cover any out of pocket medical expenses up to the limit.

One of the reason I get insurance is I don’t have to care who’s fault it is. I file against my insurance and let the professionals fight it out. I just want to be made whole again. File against your insurance and let them know what happened. If it is the properties fault then they can go after the property to pay them back, but in the meantime you can get paid and taken care of. Also check any credit cards you used for the trip, a lot of cards cover medical too on travel.
