Most Cost Effective and Legitimate Way to Remove Spouse from Deed After Divorce?

Currently separated and in the process of divorce. We are Mariott Vacation Cub owners. My partner looked into the process of removing one of us and deeding the ownership to the other. She stated the cost at almost $10,000. Just want to see what other options exist. We can keep shared ownership and attempt an agreement of splitting the points but that does not seem to be sustainable long term in the event of having established new relationships

I'll second Denise's & Marty's recommendation. Sounds like the spouse must have called a RE attorney wo doesn't normally deal with timeshares, either that or you have a bunch of weeks. It's pretty simple actually. You need a new deed and to submit the transfer form. LT transfers will do all of that. If it's enrolled, or eligible for enrollment, it will retain that status. The quoted price will be per week and in a few locations, the cost is a little more. Just make sure the one whose name remains wants to continue the ownership and associated risk. If there is a loan tied to the timeshare, you won't be able to make the change without paying it off. If you have a copy of the deed, or can print it from property records, that will help.

No additional fee beyond the transfer fee for the property and deed prep/recording that I can think of unless you also need a name change. You MAY have to reenroll but there is no charge to do so if already enrolled, you just have to contact them and this can be done by email. Below is the last fee list I had, it's from a year ago. You'd just need to complete the transfer form with just the names you want included minus the removed names. LT transfers should do this for you. You'll need signatures of all parties and a copy of legal ID such as DL or Passport. If you can send them a copy of your current deed (or certificates), that should help. This assumes it's a US property. Depending on the property, you might even be able to do this yourself but I wouldn't in this situation.

I'd suggest you contact MVC and request the transfer info yourself. Just an email off the website should be sufficient. They will send you 2 forms, the transfer from itself and the instruction pages. They may address some of the issues individually but my experience with them in the past is that mostly they just send you the forms with minimal additional info

Before I found TUG, I had gone directly to Vistana to remove one name and they directed me to their attorney and it cost $350. LTT should be able to do it for about $200 for each deed.

You have not indicated what timeshare you own. If it is in the USA, whoever quoted that price doesn't understand how ts deed transfers work in a divorce. If the ts is a deeded week, as others have said, LT Transfers can help you to prepare and record the correct paperwork in the proper venue. If it is MVC Trust Points, I suggest you reach out to the trustee, First American Title. Any changes ultimately have to go through the trustee's records, and First American Title (in Orange County Florida) does the work, you can get started on their website.

Again, the deed change will need to be properly prepared, notarized under the law of the venue, and recorded in the correct county. You did not indicate if this ts ownership transfer is also being done in connection with a marital settlement agreement in your dissolution. Make sure that the title change being requested agrees with how it is described in the MSA. And, note, whichever spouse is transferring their ownership to the other is going to be signing the document that will need to be recorded.

After everything is recorded, and you have confirmed copies, you'll need to send a copy of the recorded deed (most likely a certified copy), a copy of the relevant pages of the MSA, and the ownership modification form, plus the fee, to MVC. It will depend upon whether the H or the W is keeping the ownership. In the past, when it is the H retaining ownership, the W name is simply dropped. No need to basically do anything else. If it is the W retaining ownership, then she'll get entirely new owner account, and will need to enroll (for free) if it is a deeded week. No ROFR on family transfers, divorce transfers, etc. But all MFs must be current or it won't be processed.

If you own MVC Trust Points, there is no fee, as the points are the system itself. Transfers between spouses do not trigger the $3/point activation fee that is required with resales. If you own a deeded week that is enrolled, a divorce will not impact the eligibility of that week to be enrolled. It will retain its eligibility to enroll for whichever spouse retains ownership, and there is no enrollment fee.
