I received a sales call on my Cell Phone from Marriot They offered a free night stay and I opted out of calls.

Even though the purchase of Starwood has not been finalized, the fact I was called on my cell phone means Marriot is already using Starwood personal information.

I don't think this is the case.

The merger is not complete. They cannot legally do this as the companies must keep operations separate until the deal is approved and a "Day 1" is set for the combined company. Of course, there are integrations that need to happen leading up to this date, but generally these are kept in a sterile area with limited access to those who need it -- and certainly sales people do not need it.

Also coupled with this is that the timeshare operations are separate. ILG (Interval) acquired Starwood's timeshare operations (although that integration is also not finalized yet) -- this would be a conflict of interest allowing Marriott Vacation Club access to Starwood information. More likely would be that Marriott is using your contact information that is maintained by SPG, but even this should not happen per the above.

If it is the case, you may have grounds for a complaint.

It wasn't a big issue more of a surprise.

The fact they used my cell phone means it came from Starwood. We always give everyone my wife's cell phone number for banking etc.

It's a scam. I've been getting a bunch of these calls on my cell. First time they said Marriott & later calls have claimed to be from other hotel chains. It was on our local news just before Christmas:

Yep. It's a scam that's been making the rounds for at least a year. Marriott has issued several press releases about it including the one linked in this TUG thread from last January.

I've been part of large M&A transactions in a previous role. There is no way that a transaction as big as this would allow commingling of data for sales use prior to the "Day 1" date.

As has been posted by others, likely your cell number was acquired by other means.
